Repair/Painting Shop License for Nasseh Ghaffari-Nikou, Heartland Auto Sales Inc, 877 Westminster Street,
be approved with the following conditions:
1. The number of customer and employee vehicles on the north side of the lot may not exceed fourteen (14)

MINUTES OF THE LICENSE HEARING
Heartland Auto Sales Inc, 877 Westminster Street
Thursday, November 16, 2006, 11 a.m.

The hearing was called to order at 11:04 a.m.
Staff Present: Jeff Hawkins, License, Inspecfions and Environmental Protection (LIEP); and Jean
Birkholz, Council Research.
Others Present: Nasseh Ghaffari-Nikou, owner and Gary Van Cleve, Attorney
Heartland Auto Sales Inc: Auto Body Repair/Painting Shop License
Ms. Moermond stated that this license application is for a Class N License which requires neighborhood
notification. The City received one (1) letter of concern which means that a Legislative Hearing is
necessary. The outcome of this heazing could be one of three things: i) she could recommend to the
City Council that they issue this license without any conditions; 2) recomtnend to the City Council that
they issue this license with agreed upon conditions; or 3) recommend to the City Council that they refer
this matter to an Administrative Law Judge, which usually takes from four (4) to six (6) months. Ms.
Moermond would use this option if she thinks that there's no way that this business is workable at this
location or if she thinks that there are conditions that are absolutely necessary to make it workable that
the applicant finds unacceptable. Ms. Moermond's recommendation will come to the City Council as a
resolution and it will appear on the Consent Agenda. Typically, the City Councii will not discuss this,
unless they pull it off the Consent Agenda to send it to a judge. When it comes back from a judge, it
will appeaz on the City Council's Public Hearing Agenda. Then, the Council can either accept or reject
the findings / recommendations of the Administrative Law Judge.
Jeff Hawkins, LIEP, provided the staff report. Staff has recommended approval with the following
conditions:

The site plan was approved August 15, 2006 for eighteen (18) total parking spaces: fourteen (14) for
customers and employees and four (4) spaces for shop trucks and equipment. Zoning has approved it;
iYs an I-1 zoning district, and it is a permitted use. Fire's approval is forthcoming; there were some
issues that needed to be resolved: interior code violations like electrical panels off; things being stacked
in isles or too ciose to the paint booth; things that aze not discazded property. Those issues have been
resolved but aze seen as recurring issues. The inspector would like these issues taken caze off on a daily
basis.
Ms. Moermond questioned how long this use has been at this facility. Mr. Hawkins explained that Corp
Auto Inc. had been at this location from between 10 — 12 yeazs. Corp Auto sold it to Mr. Ghaffari-
Nikou but didn't let the City know and Mr. Ghaffari-Nikou also did not let the City know. When the
City realized that the business had changed hands, they instructed Mr. Ghaffazi-Nikou that he would
need to apply for a license, officially, and Mr. Mortezaee would need to withdraw his name from the
license.
Ms. Moermond noted that she is a bit confused about the ownership. It looks as though Mr. James Kruta
owns the property and is selling it contract far deed to Mr. Mortezaee, and that Mr. Ghaffari-Nikou is
renting from Mr. Mortezaee. Mr. Ghaffazi-Nikou responded that Mr. Mortezaee bought the place from
Mr. Kruta on a contract for deed. Mr. Ghaffari-Nikou replaced Mr. Mortezaee on that contract for deed
and is making monthly payments to Mr. Kruta. Mr. Ghaffari-Nikou has also been paying the taxes. Ms.
Moermond responded that it could be that the county has not yet caught up with the records. Mr.
Ghaffari-Nikou explained that he has only 20°to left to pay on the contract for deed.
Mr. Ghaffari-Nikou stated that they acquired the property about a yeaz ago. It is a side-arm to his auto
sales business. He uses this body shop for repairs and painting of his cars and also for customers who
have the need for body repair. There are three (3) people working there and he does not want any more
than that. The hours are from 9 a.m. to 5 p.m., Monday through Friday. He has been on good terms
with most all of the neighbors. There were mishaps that he thinks pre-dated his ownership. Regazding
the letter of objection, he told that they had inherited some cars which were situated in the back. The
easiest way of removing them was to remove a section of the wooden fence. They did it over a weekend
and put the fence back together. The following Monday, Mr. Nasvik from ThemeScapes made a
complaint that they had done things to his fence, which they thought was their fence because the fence is
on their property. Later, Mr. Ghaffari-Nikou went to Mr. Nasvik's office and apologized and told him
that he did not know it was Mr. Nasvik's fence. If he had known, he would have come to ask
permission before removing the section of fence. The issue was resolved. Two (2) months later, Mr.
Ghaffari-Nikou got an irate call from Mr. Nasvik. He was upset because there was an abandoned car in
that parking lot, a Buick. Mr. Ghaffari-Nikou told Mr. Nasvik that he didn't know anything about that
car and that they had not ever repaired a Buick. Mr. Nasvik assumed that it was Mr. Ghaffazi-Nikou's
vehicle. Another time, someone had dumped a suitcase, tires, etc. in the lot and again, Mr. Nasvik was
irate about that. That parking lot is behind Mr. Ghaffari-Nikou's property and they have no conuol over
it; in fact, they cannot even see it. Just yesterday, Mr. Ghaffari-Nikou met with Mr. Nasvik's son, who
runs ThemeScapes. The son was very pleased with the landscaping that they had done, the privacy
fence that they had erected and the rest of the improvements that Mr. Ghaffazi-Nikou had made to the
property since acquiring it. The son and Mr. Ghaffari-Nikou will meet with Mr. Nasvik sometime next

week when Mr. Nasvik retums from vacation. The goal of the meeting is to work on ways to make both
their properties more desirable, so that eventually they can be sold as a whole.
Mr. Ghaffari-Nikou went on to say that the neighbors really seem to like them there. They have never
had anyone complain about anything. He is striving to make the properry look as good as can be for an
old place.
Ms. Moermond asked to look at the maps of the area.
Mr. Ghaffari-Nikou offered that the EPA came in to inspect and was satisfied with the way that he was
handling the hazazdous materials.
Mr. Ghaffari-Nikou noted that he will be making a daily "To Do" list for his employees in order to keep
the shop clean and uncluttered.
Ms. Moermond asked whether they will be doing auto body repair or general mechanical repair at this
site. Mr. Ghaffazi-Nikou responded that they will be doing only auto body repair at 877 Westminster
Street. Mr. Hawkins stated that auto body repair, by definition in the City of Saint Paul, would include
taking any part off and replacing it. Mr. Ghaffari-Nikou also has an auto repair license at his car lot.
Mr. Ghaffari-Nikou added that he has a storage facility in Little Canada to stare vehicles until they can
be brought to the body shop.
Ms. Moermond recommended approval of this license with conditions as recommended by LIEP.
The hearing was adjourned at 11:45 a.m.

RE: Heartland Auto Sales License Application
At last week's Council meeting you pulled the resolution granting an auto repair/painting shop license off
the consent agenda. You asked me about the letters of concern and testimony related to the issuance of
this license, and then the Council laid the item over for 1 week to allow for follow-up. Attached are all of
my records relative to this license matter and a summary of these follows.
There were 2 letters of concern received about the issuance of this license. The first was from Bette
Revoir of 708 East Hawthome. She indicated she believes the business has used the street for parking,
thereby decreasing the on-street parking for residents. It was not clear to me if this concem was relative
to this location, or about another site which is on the east side, the Heartland Auto lot at 1236 Arcade,
where they have second hand dealer (auto) and auto repair licenses. The second letter was from Peter
Nasvik, owner of ThemeScapes at 864 Terrace Court, a landscaping business located immediately
adjacent to the applicant. He indicated there has been an issue with a section of fence, and this was
discussed in the hearing. Testimony by Nasseh Ghaffari-Nikou leads me to believe there was an
independent settlement in this matter. Mr. Nasvik also expressed that he believed the owner had already
violated all of the conditions the City intends to place on his license. There was no letter or email from
the dish council. No one was present testifying against the issuance of the license.
As this is a new license in this location, I had only a little history with which I could work. It appears
there have been correction orders issued for this business by both Fire and Licensing, but both
departments indicated the corrections have been made and they recommend approval of the license with
the agreed upon conditions.
W ith respect to the Arcade lot, adverse actions were taken on these license on both February 4, 2004 and
October 19, 2005, both for too many cars on the lot. In 2004, the penalty was a 10 day suspension and
$1,000 fine (5 days and $500 of which was stayed pending no same or similar for 12 months). In 2005,
the penalty was a 30 day suspension and fine of $1,500 (25 days and $750 of which was stayed for 18
months pending no same or similaz).
No information about the Arcade Street location was presented by letter, testimony or staff report in the
Legislative Heazing. It seems reasonable that the Council may wish to have this addressed in another
legislative hearing or heard by an administrative law }udge.
Finally, I talked with Christinee ROzek about this situation and she indicated licensing staff are hopefixl
that the addition of the Heartland Auto Sales location on Westminister will releieve some of the pressure
being experienced by the neighbors of the Arcade location.

Dear Ms. Moermond
I received your letter regarding Heartland Auto Sales Inc This business has been
a nuisance to our properiy and the businesses therein ever since �ie purchased our
building. Heartland employees have repeatedly removed secrions of our wood fence to
pull wrecked cars in and out of their lot. Our fence shows the wear and much of it should
be replaced. They have parked wrecked cars in our lot on occasion as well. I have
comptained to them, with little or no response. They have violated most every one of the
eleven conditions you are requiring for as long as we have been here (10 yeazs).
Heartland's business is an obvious eye sore and detriment to the area.
We would love to see them move elsewhere. If the City of Saint Paul enforces
the conditions of their license, I can't imagine that Heartland can operate their business.
I'm certain that Saint Paul will have continued compliance problems with this business
for as lon� as they are allowed to stay in this location.
If the City will enforce the conditions of the license, I'm okay with the issuing of
a new license. We would prefer that they go eisewhere.
