WHEREAS, AftAn Alps has offered to donate between 360 and 38� paus of used Elan XRP skis with a value of
between $18,000 and $19,000 to the St. Paul Division of Pazks and Recreation; and
WHEREAS, Afton Alps has advised that the sMs cany no warranries and that they wish to be relieved of any future
]iabilities associated with the use of the skis in the event of an accident; and
WHEREAS, the City Council finds that the acceptance of the skis will enhance accessibility to sporting activities by
the citizens of St. Paul and that the expenditure of public funds in the form of a promise of indemnification for such a purpose
will serve a public purpose by increasing outdoor athletic opportunities in the City; now, therefore, be it
RESOLVED, that the City thanks Afton Alps for its generous gift ofthe Elan XRP skis; and
FLJRTHER RESOLVED, that the Clry agrees to indemnify Afron Alps against any claims for damages or injuries
which result from the use of the skis subsequent to theu transfer to the City, but not to exceed the municipal tort liability limits
set forth in Minn. Stat. 466.01 et seq; and be it
FINALLY RESOLVED, the City accepts the gift of the skis, and appropriates them for the use by the Division of Pazks
and Recreation in its skiing facilities and/or classes.
