White as Assistant Exec�- tive Secretary of the Saint Paul Human and Civil Rights Commiasion, and whether or not his place of residence could prev�ent h3m from being eligible for the poait3.on. The position of Aasistant Executive Secretary was established by the Saint Paul City Council, pursuant to Chapter 7�+ of the Legis- lative Code, as amended by C.F. No. 219213, approved August 13, 1g6�+, said chapter grantin$ the Civil and Human Rights Commission the power and duty of appointing an assistant executive aecretary, aub�ect to the council' s approval and excepting auch position from , Section 100 of the Charter. It is our opinion that the residence requirement applicable to the assistant executive secretary is that he be a bona fide resident of the City of Saint Paul during the time of his employment and tha� the City Council ' s approval of Mr. White' s appointment to . said position acts as a waiver� as to his residence a� that time.
