Dear Sir:
This is in reply to the referral of the appeal of Cecil T. Murray to ;
, legalize and continue an existing illegal four-family use on property �
classified in the "B" residence district. The subject property is de- .
scribed as the west 4 feet of Lot 8 and all of Lot 9, Block 4, Nininger & .
Donnelly`s Addition and is situated at the southeast corner of Dayton
Avenue and Victoria Street. - '

In 1889 the subject property was developed with the existing structure, ;
, then a single-fami.ly use. At some unknown date, this structure was � '
extended to a fi�ae-family use which did not necessitate an enlargement
of the original structure. Because the property is classified as "B" '
residence which limits it to a twe-family use, the applicant must secure _ _
Council authorization pursuant to Chapter 64.03 of the Legislative Zoning �
Code to continue the use of the,property as a four-plex. •
The Board of Zoning heard this request on May 6, 1965. It was the Board's
finding that it would be reasonable to permit a four-family use for the _
. remaining life of the structure, subject to compliance with the changes
set forth in the Bureau of Public Buildings and Housing Code Division _ i
report dated April 29, 1965, a copy of which is attached. The applicant �
concurred with these conditions. '

It is, therefore, the Board of Zoning's recommendation that the use of �
the subject property be�permitted to c�intinue as.a four-plex for the _
li�e of the structure, subject to the conditions as outlined above. �
