Code by Reuben G. Thoreen� attorney for Anna M. Russell� -
deceased� as owner of the subjeet property situated in the
City of Saint Paul� described as Lot 2� Block 4� Nininger & �
Donnellyts Addition, located on-propertyon the south side
, of Dayton Avenue between Fisk and Victoria Streets� that the
. provisions of "said Zoning Code hereby are determined and varied
�in application so that the premises may contain separate
accommodations for several� not in excess of four families� -
provided that the continuance of such four-family dwelling be '
. for the remaining life of the structure now on said pr-emises� �
and provided further that the applicant comply with the ehanges �
set forth in the Bureau of Public Buildir�gs an.d Housing Code `
Division report dated April 29, 1g65, and provided further, ,
that such permission shall lapse ipso facto unless the appli- �
cant is in full compliance with the above report dated April-'29� ,
1965, within one year from the date of this resolution,
acceptance of which resolution and terms to be made by the
applicant� and subject to complianee with said provisions the
Council expressly finds that such relief will be consistent -�

Tfiis is in reply to the referral of the appeal of Reuben G.Thoreen, �
' - attorney representing Anna M.R�assell, deceased, to continue an exist-
. ing illegal four-�amily rasidence use on property which is described Y
- as Lot 2, Block 4, Nininger & Donnelly's Addition and which is located
. on the south side of Dayton Avenue betaveen Fisk and Victoria Streets.
� The property is zoned "B" residence and has been so classified since - ;
the enactment of the Zoning Code in 1922. � _
� . . x
- The subject property was developed with the existing structure in 1890 �
as a single-family dwelling and has since been extended to eight units d
without proper a'uthorization. It is proposed through this action to re- ;
duce the number of units to four and continue the use. Because the pro- ;
perty is classified as "B't residence which limits it to a two-family use,
the applicant must secure Council authorization pursuant to Chapter 64.03 of �
- the Legislative Zoning Code to continue the above requested use. -
The Board of Zoning heard this request on May 6, 1965: It was� the
• Board's finding that it would be reasonable to permit a four-�amily
� use for the remaining life of the structure, subject to compliance
with the changes set forth in the Bureau of Public Buildings and Hous-
ing Code Division report dated April 29, 1965, a copy of which is -
. attached. The appli.cant concurred with these conditions.
I�t is, therefore, the Board of Zoning's recommendation that the use of
- the subject property be permitted to continue as a fourplex §or the
life of the structure subject to the conditions as outlined above.
