This is an e�e'rgency Ordinance render- ed necessary fnr the preservation of the pub- .lic peace, health�and safety. . THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: �,� Section 1. The City of Saint Paul may lease private pro- � perty for the purpose of establishing landfill sites for the disposal of demolition�materia�l,,. trees, stumps, wood and lwaber. The use of said land- fill sites shall be restricted only to material collected within the corpor- ate limits of;the City of Saint Paul. �Sec�ion 2. Said City through its Department of Public Works and the Bureau of Sanitation of said department shall establish rules and regulations for the use of said la.ndfill sites and may enter into agxee- ments with those who wish to use said landfill sites. �Section 3. The, following fees and charges for disposal ' � pri vileges at said landfill sites are hereby fixed: 1. Pickups or 4 Wheel Trailers .75 per laad 2. Trucks-single axle, single wheels-capacity to 5 cubic yards 1.50 per load 3. Trucks-single a.xle, single or �, dual `wheels-8 cubic yards capacity 2.00 per load '+� - 4. Commissioner of Public Works 234 City Hall .Dear Commissioner: On February 18, 1965, forty-five residents surrounding the deep ravine located between Euclid, Frank and Wakefield petitioned for filling of this ravine with refuse. Because burning was discontinued at our Pig's Eye Landfill, due to the insistance by the Smoke Abatement committee that we were polluting the air, it was necessary under the former agreement with the railroad com- pany that demolition, wood or trees be burned if deposited on their pro- perty, we had to stop the disposal of these materials in this area. The thought then occured that, if the area bounded by Frank, Wakefield and Euclid could be used for the disposal of these materials without cost to our department that several factors could be resolved. „ �. �The improvement of the land for future use which could increase the revenue of taxes on these pro- perties. � 2, The elimination of a very dangerous condition for neighborhood children and nearby residents. 3. The proper control of disposal of these materials , within our eity limits. 4. The cooperation between our Department and the pro- posed renewal of our Urban 'Renewal Program. It was then necessary to contact all landowners in the ravine for per- mission to fill their lands, plus asking them to provide liability insur- ance at their own expense and having the City of Saint Paul as co-insured. It was also provided through continuous contact with the owners that per- mission be given the City of Saint Paul to charge fees for users of this area in order to be self-sustaining. To this point all owners have agreed to the conditions and agreements and insurances are provided. " " � Hon. Milton Rosen - Page - �vo �. A "rough draft'� of an ordinance setting fees for disposal 'at this area of demolition, trees and wood was presented to all known demolition contrac- tors and tree trimmers for discussion at a meeting on July 21, 1965. A fac- tor was brought up at this meeting regarding the proposed hours of operation between 8:00 A.M. and 5:00 P.M, on Monday through Saturday would cause a confliction of requests by the Department of Public Works. The first condition was that in certain instances,� demolition must be done at night and on Sundays through conditions as set forth by the Traffic Com- mittee. Secondly, our bureau through the proposed ��rough draft'� of the ordinance would set the hours of opening between 8:00 A.M, and 5:00 P.M. Monday through Saturday. A general meeting of residents surrounding this ravine was held in the Johnson Brothers parking lot at 7:30 P.M, on September 1, 1965, and I was asked to attend for the purpose of answering questions as to why the delay in filling the ravine. I explained that the delay was mainly due to the rewording of property owners agreements by the City Attorney's Office and that several conditions would have to be straightened out between the City of Saint Paul, the general con- tractors and the property owners. Anticipating that questions pertaining to health and also that an explana- tion be given regarding night hauling and Sunday hauling, I asked Mr. Robert Peterson of the Traffic Division and Mr. Henry Streich of the Health Depart- ment to attend this meeting with me. They most graciously accepted, and the residents totaling approximately sixteen expressed their sentiments that night hauling and Sunday hauling would not bother them; but that their main concern was to have this ravine filled. A special clause inserted into the proposed ordinance would give the Department of Public Works the right to enter into agreements with demolition contractors or tree trimmers for use of' the facility after the regular posted hours. Through the excellent cooperation from Mr. Eugene Avery, City Engineer and Mr. Jerry Connolly, Public Works Accountant, I am sure we can reach a satisfactory solution as to charges for after hours hauling. I would, therefore, strongly recommend that the proposed ordinance be present- ed at the earliest possible opportunity. I am sure you .realize that this would not only pertain to the location we are now contemplating but also cover any and all new areas that we could procure in the future.
