This is in reply to the referral of the appeal of Ida A. genyon and Ruth E.
Furstneau to legalize and continue an existing illegal three-family use on
- property classified in the "B" residence district. The subject property is
described as qt 0 �Bloc� 11, Nininger�`s� & Donnelly's Addition to HolcombC,s
AdditionTand is�s tuat- ed �t the northeast corner of Laurel Avenue` and Fisk St.
• In June 1922, the Subject property was developed tvith a two-story two-family
residence. �tt some unkriown date, this structure was extended to a three-
family use which did not necessitate an enlargement of the original structure.
Because the property is classified as "B" residence which limits it to a
two-family use,the applicant must secure Council authoriza�Cion pursuant to
Chapter 64.03 of the LegisTative Zoning Code to continue the use of the pro-
perty as a three-plex. _ '
The Board of Zoning heard this request on July 1, 1965. It was the Board's
finding that it would be reasonable to permit a three-family use for the
remaining life of the structure, subject to the provision of one off-street
parking space in addition to the existing two-car garage and to compliance
_ with the changes set forth in the Bureau of Public Buildings and Housing Code
Division report d�ted June 9, 1965, a copy of which is attached. The appli-
cant� concurred wit� these conditions..
It is, therefore, the Board of Zoning's recomwendation that the use of the
subject property be permitted to continue as a three-plex for the life of
' the structure, _subject to the conditions as outlined above. It is also re-
commended that, should the Council see fit to grant the appeal, that a copy
of the resolution be filed with the deed in the Register of Deed's office.
