An ordinance granting permission to St. Paul
Foundry & Manufacturing Co., a corporation, to
construct a public sidewalk on the west side of
Mackubin Street from the sauth,curb line of Como
Avenue`to a point 74 feet south of the same,
incorporating a set of concrete steps, a concrete
wall, a railing and lighting facilities, according
to plans and specifications furnished -by said
permittee and approved by the Commissioner of Public
Works. This is an emergency ordinance rendered
necessary for the preservation of the public peace,
health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby granted
to St. Paul Foundry & Manufacturing Co.; a corporation, to con-
struct a public sidewalk on the west side of Mackubin Street from
the south curb line of Como Avenue to a point 74 feet south of
the same, incorporating a set of concrete steps, a concrete wall,
a railing, and lighting facilities, upon its compliance with the
following conditions, viz:
(1) Said permittee shall construct said sidewalk, concrete
steps, concrete wall, railing and lighting facilities
entirely at its own expense, under the supervision and to
the satisfaction of the Commissioner of Public Works, and
in accordance with plans and specifications furnished by
said permittee and approved by the Commissioner of Public
Works.
(2) Said permittee shall pay the cost of engineering and
inspection of said work, and for the cost of publication
of this ordinance.
(3) Said permittee shall properly protect all excavations
made in the performance of said work, so as to prevent
damages or injuries to persons or property during the
course of construction.
(4) Said permittee, after the inception of said work, shall
prosecute the same continuously and fully complete said work,
to the satisfaction and approval of the Commissioner of
Public Works, on or before July 31, 1966.
(5) Said permittee shall adequately maintain, furnish all
necessary yi pk'A . and equipment therefor, and operate said
lighting facilities as required to afford reasonable safety
for pedestrian travel at or adjacent to the location of the
same, all at said permitteels expense.

(6) Said permittee shall furnish a bond to the City of
Saint Paul in the sum of Ten Thousand Dollars ($10,000.00),
conditioned to comply with all the terms of this ordinance
and to indemnify and save harmless said City from all
liability, charges, loss, judgments, suits, costs or
expense that may accrue to person or property occasioned
by the making of said improvements or arising out of the
same.
(7) Said permittee shall, at its own cost and expense,
furnish and file policies of casualty liability insurance,
for a term or terms commensurate with the maintenance of
said improvements, whereunder the City shall be designated
as Insured or Co- insured, in the following insurance cover-
age amounts: for personal injuries $100,000 for each person
injured, and $200,000 for two or more persons injured in
any single accident, and for property damage $50,000 for a
single accident and not to exceed $100,000 in the aggregate
for any number of accidents in a single year.
(8) Said permittee shall, within ten days after the passage
and publication of this ordinance, file a written acceptance
thereof with the City Clerk.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered,necessary for the preservation of
the public peace, health and safety.
Section 3. This ordinance shall take effect and be in force
upon its passage, approval and publication.
