RF�OLVED, upon the pertinent appeal under the Zoning
Code by Alvin �• Henke� as owners of the sub�ect property situated
in the City of Saint Paul� described as the West 14 feet of Lot 7
and all of Lot 6, Block 1, Hallerts Addition to St. Paul� located on
the north side of Dayton Avenue between Milton and Victoria Streets�
that •the provisions of said �oning Code hereby are determined and
varied in application so that the premises may con.tain separate
accommodations for several, not in. excess of three families, pro-
vided that the continuance "of such three-family dwelling be for
the remaining life of the structure now on said premises, and
provided further� that the applicant comply with the changes se�
forth in the Bureau of Public Buildings and Housing Code Division
report�dated June 9� 1965� and provided further� that such permission
shall lapse� ipso facto� unless the applicant is in f"ull compliance

� This is in reply to the referral of �the appeal of Alvin �� Henke to per-
mit a four-family use on property classified in the "B" residence district.
The subject property is�described as the west 14 feet of Lot 7 and a11 of
Lot 6, Block 1� Haller's Addition and is located on the north side of Day- __
ton Avenue between Milton and Victoria Streets. .
In 1906 the subject property was developed with a 2� story, two-family -
residence. At some unkriown date, the property was converted to a four--
family use. However, at the present time, it is occupied as a three-family
' use. Because the property is classified as "B" residence which limits it
to a two-family use, the applicant must secure Council authorization pur-
suant to Chapter 64.03 of the Legislative Zoning Code to use the property
as a four-plex. . '
The Board of Zoning heard this request on July 1, 1965. It was the Board's
finding that inasmuch as off-street parking can be provid'ed for only three
cars, that the use of the property should be limited to three families, and
that such use be sqbject to compliance with the changes set forth in the
Bureau of Public Buildings and Housing Code Division report dated. June 9, . �
1965, a copy of which is attached.
It is, therefore, the Board of Zoning's recommendation that the use of the
subject property be permitted to continue as a three-plex for the life of
the structure, subject to �the conditions outli.ned above. -It is also re-
commended that, should• the Council see fit to grant the appeal, that a copy
of the resolution be filed with the deed �in the Register of Deed's office.

The lot size of this property is 60 feet in width with a
depth of 127.75 feet.
The houae was built prior to August 22, 1922.
The property at the present time is bein used as a three-
family residence. It is requested that perm� sa- on be granted
o use e proper y as a residence for not in excess of four
families. If I were not able to continue to use e property
as a residence for three or four fa.milies, I would be forced
to sell or otherwise lose my investment in this property.
