the attached appeal of C. G. Rein Development Co. for permi.t to
establish a 1'4" building line setback from St. Pa.ul Ave. on
property on the south side of St. Paul Ave. between Davern and
Snelling Aves. , as more fully described in the attached letter
of the Zoning Board.

This is in reply to the referral of the appeal of the C. G. Rein
. Development Company to establish a 1'-4" building line setback
- from St. Paul Avenue on property located on the south side of �
. St: Paul Avenue between Davern and Snelling Avenues which is
dPSCribed as that part of Lot17 lying south of St. Pau1 Avenue -
and northerly of a line 140 feet north of and parallel to the '
north line of Wilmot Avenue, Snelling Outld�. The property is
_ � zoned "C" residence. �
_ The Board of Zoning consider.ed this matter at its':regular meet- .
i'ng on July 1,,., 1965. The staff reported that the purpose of the -
� requested setback was to permit construction of a screening wall
for a recently constructed swimming pool. TheBoard found that
the requested setback would lzot have a detrimental effect on any
of the adjoining or surrounding properties in the area, and that
it wou].d not affect the light and air of the_ applicant's adjoin-
ing apartment buildings to the east and west.
In consideration of these factors, the Bo#xd of Zoning recommends .
the granting of the requested 1'-4" setback from St. Paul Avenue
on the above described property. It should be poi'nted out that
' the City Council granted informal approval of this request on

walls surrounding the swimmi.ng pool and patio area at the above
projec,t. We reques��that the building line for a length of 105 feet
along St. I�aul Avenue and located adjacent to this ,scaimming pool
and patio area be changed to a :Z'-4" set back.� � � `�

The enclosed plans show: 1) the general location of the swimming,
pool and patio area crith re£erence to the entire project and; 2) more
detailed plans of the area itself. These fences and walls are necessary
as safety and security measures £or this area.
Also enclosed is a $20.00 check for the required Eiling fee.

this security fence as it was shown on our original plans and speci�ications
Eor�which we obtained a permit, we are now prohibited from completing
construction. We there�ore request that the City Council give us an
informal approval at the earliest possible council meeting so tha.t we
may proceed at our own risk to complete the improvements.
