3 WHEREAS, the Saint Paul City Council adopted Council File #06-672, on order to Remove or Repair the
4 building(s) at 2038 Fourth Street East amending it to grant the owner 180 days for rehabilitation of the
5 structure, conditioned upon the owner developing a work plan with 30-day deadlines to be approved by the
6 Legislative Hearing Officer; and
8 WHEREAS, the properry owner, Mazk Dochniak, has failed to meet the September deadline to submit a
9 30-day work plan, has failed to obtain the necessary permits to do the work, and has failed to contact the
10 appropriate inspectors to determine whether any completed work is in compliance and

12 WHET2EAS, the Saint Paul City Council scheduled a Public Heazing on Wednesday, November 1, 2006 to
13 consider rescinding the grant of 180 days for the rehabilitation of 2038 Fourth Street East and notified Mr.

Dochniak more than two weeks in advance of this hearing; and
WHEREAS, Mr. Dochniak did not appear and no new information or testimony was provided at the public
heazing to mitigate the profound concern this building will continue to be public nuisance; and
WHEREAS, the Saint Paul City Council voted 7-0 to modify the existing order to remove or repair the
building(s) in 180 days articulated in Council File #06-672, and order the building(s) removed within 15
days based on the lack of compliance with the original orders; now, therefore, be it
RESOLVED, that the Saint Paul City Council hereby memorializes its decision to arder the property at
2038 East Fourth Street removed within 15 days of the adoption of this resolution.

referenced public heazings, the Saint Paul City Council hereby adopYs the following Findings and

That the Subject Property comprises a nuisance condi#ion as defrned in Saint Pau1

the Subject Property.

5. That the deficiencies causing this nuisance condition have not been conected.
6. That Neighborhood Housing & Pruperty Improvemenf has posted a placard on the
Subject F'roperiy which declazes it to be a nuisance conditian subject to demolition.

8. That tbe known interested parties and owners aze as previously stated in this resoiution
and that the notiHcation requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Panl City Council hereby makes the following order:
i. The above referenced interested or responsible parties shatt make fhe Subject Property
safe and not detrimental to the public peace, heaith, safety and welfaze and remove its
bligh#ing influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above refarenced Ekder fo Abate Nuisaace

Inasmuch as this Order to Abate has not been complied with the nuisance condition
remains unabated, tfie community continues to suffer the blightin� influence of this

Improvement that the City Counci2 pass a resolurion ordaring the responsible parties to
either repair, or demolish and remove tkzis building in a timely manner, and failing that,
authorize the Neighborhood Housing & Property Improvement to proceed to demolition
and removal, and to assess the costs incurred against the real estate as a special
assessment to be collected in the same manner as taxes.

Eask If the owner fails to comply with the resolution, Neighborhood F3ousing and Property
Improvement is ordered to remove the buiiding. (NF�'n
Mr. Magner stated the building was a two-story, wood &ame sing3e-family dwelling on a lot of
5,227 sguare feef. 'Fhe buildiug had been vacant since September 24, 2d04 due to a fire. The
building also constituted a nuisance as there I�d been seven summary abatements at the
properiy: 1} severai notices to remove garbage, rubbisk, scrap wood; and 2) several notices to cut
fall grass and weeds. 'The vacant bui2ding fees were due aud owing in tbe amount of $375.00, a
code campliance inspection had been conducted on April 27, 2005, however, a perfarn�ance
bond had uot been posted. According to Ranzsey County Taxation, ta�ces and martgage
payments were current. Taxation k�ad glaced an estitnated market value of $45,500 on Yhe 2and
and $75,000 on ihe buiiding. 'I'he estimated cost to repair The building was approximately
$8�,OQ0 to $90,000. The estimated aost tA demolish the building was approximately $8,000 to
$9,000. It was his opinion that fhis boarded building was also an attracrive nuisance and a place
for youth to congregaYe. He presented photographs of tfie buiiding.
Mazk Dochniak, property owner, stated #he mortgage company had locked him out and when he
cut fhe Iock off so he could continue the rehab work, they put another lock on the door. The
interior of the house was completely gutted and he had replaced some of the windows. He also
stated he had paid the parformance bond with a personal cheok on 7uly 3, 2006. He c�urentiy
had an ontstanding balance of $10,000 owing on his mortgage and he believed he would have
had the work completed by now if he had not been locked ouY.
Mr. Magn.er stated he believed the mortgage company had concerns about disbursing all of the
funds because they were uns�ue whether the funds were being used to complete rehabilitafion on
the house. The settlement with the insurance company was $67,000 aud the martgage company
retained $10,000 ofthase funds.
David McCalip, attomey with WiIford & Geske, stated he had been retained by the mortgage
company, GMAC, to represent them on this matter. It was his understanding that the property
had not been foreclosed an.
Ms. Moermond recommended laying over to July 25 Legislative Hearing provided the following
condirions aze met by noon on July 19, 2006: 1) a$S,D00 performance bond is posted; 2) an
agreement is reached between the owner and GMAC, the mortgage company, oa complefion of
the rehabilitarion.

The entry way has collapsed into
the void beneath the steps. The
entire house is littered with cans,
debris and junk. The upstairs
bathroom was not functioning and
had what appeared to be feces
piling up in the dry toilet.

11, 2006 to submit this informarion. If you fail to do so, Ms. Ivfoermond will reconsider the
original order to remove the building within 15 days to the City Council at the October 18, 2006
City Council Public Hearing.
