(NF�'n Mr. Magner stated the building was a two-story, wood &ame sing3e-family dwelling on a lot of 5,227 sguare feef. 'Fhe buildiug had been vacant since September 24, 2d04 due to a fire. The building also constituted a nuisance as there I�d been seven summary abatements at the properiy: 1} severai notices to remove garbage, rubbisk, scrap wood; and 2) several notices to cut fall grass and weeds. 'The vacant bui2ding fees were due aud owing in tbe amount of $375.00, a code campliance inspection had been conducted on April 27, 2005, however, a perfarn�ance bond had uot been posted. According to Ranzsey County Taxation, ta�ces and martgage payments were current. Taxation k�ad glaced an estitnated market value of $45,500 on Yhe 2and and $75,000 on ihe buiiding. 'I'he estimated cost to repair The building was approximately $8�,OQ0 to $90,000. The estimated aost tA demolish the building was approximately $8,000 to $9,000. It was his opinion that fhis boarded building was also an attracrive nuisance and a place for youth to congregaYe. He presented photographs of tfie buiiding. Mazk Dochniak, property owner, stated #he mortgage company had locked him out and when he cut fhe Iock off so he could continue the rehab work, they put another lock on the door. The interior of the house was completely gutted and he had replaced some of the windows. He also stated he had paid the parformance bond with a personal cheok on 7uly 3, 2006. He c�urentiy had an ontstanding balance of $10,000 owing on his mortgage and he believed he would have had the work completed by now if he had not been locked ouY. Mr. Magn.er stated he believed the mortgage company had concerns about disbursing all of the funds because they were uns�ue whether the funds were being used to complete rehabilitafion on the house. The settlement with the insurance company was $67,000 aud the martgage company retained $10,000 ofthase funds. David McCalip, attomey with WiIford & Geske, stated he had been retained by the mortgage company, GMAC, to represent them on this matter. It was his understanding that the property had not been foreclosed an.
