No. 221353, approved January 6, 1965, awarded the con- tract for construction of the Trout Brook Sewer Extension Repair No. 2 Interstate Highway 35E and Vicinity of Maryland Avenue to Hurley Construction Company for the contract price of $67,992.00, said contract price among other things being based on Hurley Con- struction Company furnishing and driving 34 steel "H" piles - 10 BP 42 #, WHEREAS, After completion of said construction the records of the Department'of Public Works show that Hurley Construction Company drove 2,8+8.6 lineal feet of the 4,080 lineal feet of steel piling orde'red pursuant to said contract and said company -does now request an adjustment in the Unit Price for increases or decreases for piling driven. now therefore be it RESOLVED, That Contract No. L -6722, Project No. 64 -5 -969, dated January ll „ 1965, by and between the City of Saint Paul and Hurley Construction Company be and the same is hereby adjusted, due to the decrease in footage of steel piling driven, so as to reduce said contract price by the sum of $3,18+.75, according to the formula contained-in the attached letter, dated November 1, 1965, signed by C. P. Due to the fact that the Contractor had to order the total amount of steel piling immediately, leaving him with 1231.4 lin. ft. of steel piling not driven, the agreement proposes to allow the Contractor the net cost to him of the 816 lin. ft. for which the full deduction is taken. This would be at the rate of $1.82 per ft. based on the actual cost of $0.0733 per lb. less salvage value of $0.03 per lb. or a net of $0.0433 per lb. for 42 lbs.per ft. which is $1.82 per ft. In summary, the proposed settlement is as follows: 20% of 4080 lin. ft. = 816 x 5.00 = $4080.00 415.4 x 1.42 = 589.87 Gross Deduction $4669.87 Allowance to Contractor: For piling not driven 816 x 1.82 = $1485.12 Net Deduction $3184.75 This should cover the deduction due to the pile driving operation.
