Works Technical Services, Vacation File Ntunber 12-2006, the public property hereinafter
described, as follows and on attached map Eahibit A, is hereby vacated of its interest as street
right-of-way:
That part of Bayless Place (dedicated as Raymond Avenue on the plat of St
Anthony Pazk) described as follows:
Lying northeasterly of a line beginning at the intersection of the
southeasterly line of Bayless Place (dedicated as Raymond Avenue on said
plat) with the northeasterly line of Bayless Avenue (dedicated as Vane
Street on said plat); thence northwesterly to the intersection of the
northwesterly line of Bayless Place (dedicated as Raymond Avenue) with the
easterly line of the unnamed street as dedicated on said plat(said unnamed
street passes through Hampden Pazk and lies between Bayless Avenue,
dedicated as Vane Street and Hampden Avenue), there said line ternunates.
Also lying southwesterly of a line commencing at the intersection of the
southeasterly line of Bayless Place (dedicated as Rayxnond Avenue) with the
northeasterly line of Bayless Avenue (dedicated as Vane Street); thence
northeasterly along the southeasterly line of said Bayless Place (dedicated as
Rayxnond Avenue) 73.50 feet to the point of beginning; thence northeasteriy,
deflecting to the left 41 degrees 20 minutes 00 seconds to the intersection of
the northwesterly line of Bayless Place (dedicated as Raymond Avenue)there
said line terminates.
And that part of the unnamed street which passes through Hampden Pazk and
lies between Bayless Ave. (dedicated as Vane Street on the plat o�St.
Anthony Pazk) and Hampden Ave. described as follows:

Easement Certificates of Intended Non-Use, filed voluntarily on behalf of: Market Street
Energy Co. for District Energy Saint Paul, a limited liability company; Qwest Coporation,
a Colorado corporation; Xcel Energy dba NSP Co, a private utility; Saint Paul Regional
Water Services, a municipal corporation; Comcast, a Pennsylvania corporafion; made a
part hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for
itself and on behalf of these corporations and departments, waives the right to the street right-of-
way and utility easements in the area to be vacated, described above and subject to the following,
including:
This vacation sha11 be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
That easement rights aze retained on behalf of the City of Saint Paul Public Works
Deparhnent to use, maintain and service existing sewer facilities and manhole access to

2. That the petitioner, their successors and assigns agree to indemnify, defend and save
harmless the City of Saint Paul, its officers and employees from all suits, actions or claims
of any character brought as a result of inyuries or damages received or sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this
property, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.

RE: Our File 12-2006 (Vacation of Bayless Place between Raymond and Bayless Avenues)
The City of Saint Paul is pefifioning for the vacation of that portion of Bayless Place that lies
between Rayxnond Avenue and Bayless Avenue, within Hampden Park. This area is no longer
used as a street; permanent abutments restrict each end of this portion of street, pernutting no
ingress from any direction. The City owns all abutting property and no private parties are
directly afFected.
As indicated, this inquiry pertains to the vacation of City right-of-way only; utility easements
may remain in place even though street usage has been removed.
The purpose of this vacation is to allow the flow of green space within the pazk, if removal of the
road is a future consideration. It also allows maps and records to accurately record the current
(non-street) use of the property.
Will you please advise me of any concerns qou may have regarding this proposed vacation as
soon as possible. I would like to receive your comments before August 3, 2006 so I can prepare
a report to the City Council on this matter. If you would rather respond on your letterhead,
please refer to the above listed file number when replying. For your convenience, you will find
an inquiry reply form and Certificate of Intended Non-Use enclosed with this correspondence.

I recommend a public hearing before the City Council be held on November 1, 2006
to consider the petition of the Ciry of Saint Paul.
This petition is to vacate two unimproved street rights-of-way, determined by the
Saint Paul Department of Public Works to be surplus, that intersect Hampden Park.
The purpose of this vacation is to allow documentation of vacated right-of-way in
order to update city and county maps to reflect the use and function of this property
as park purposes.
This property is located in City Council Ward 4, Planning District 12.
