(Subject to the rights of the public in Upper
Afton Road and McKnight Road.);
for the sum of Seventy Thousand Dollars ($70,000.00); and

WHEREAS, said agreement was not recorded and the City
still is the owner of record with respect to said tract or
parcel; and
WHEREAS, the State of Minnesota, acting by and through the
Commissioner of Highways, has heretofore sought an option to
purchase a relatively small portion or tract of the aforementioned
tract, the parcel which the State desires to acquire being de-
scribed as:
That part of the West half of the Northwest Quarter -
of Section 1, Township 28 North, Range 22 West;
which lies westerly of a line run parallel with and distant
100 feet easterly of the following described line:
Beginning at the northwest corner of said Section
1; thence run south on the west line of said
Section 1 for 550 feet and there terminating;
together with all that part of the above described
tract adjoining and easterly of-the above described

with and distant 75 feet southeasterly of the following
described line: From a point on the west line of Sec-
tion 36, Township 29 North, Range 22 West, distant
577.1 feet north of the southwest corner thereof, run
southeasterly at an angle of 79006'15" with said west
section line for 39.72 feet; thence deflect to the
right at an angle of 79006115" for 634.3 feet; thence
deflect to the left at an angle of 100000' for 100.3a
feet; thence deflect to the right at an angle of 168 00'
for 100 feet to the point.of beginning of the line to be
described; thence run northeasterly on the last described
course for 3+6.98 feet; thence deflect to the right on a
3000' curve (delta angle 14020150") for 478.25 feet and
there terminating;
containing 1.22 acres, more or less, in addition to
the existing highway;
together with all right of access, being the right of
ingress to and egress from all that portion of the above
described tract, not acquired herein, to Trunk Highway No.
94, except that the abutting owner shall retain the right
of access _ southerly -of a point-distant-300 feet south of the
northwest corner of said Section 1 (when measured along
said west section line);
and the State has agreed to pay for such tract or parcel the sum
of Eight Thousand Six Hundred Dollars ($8,600.00), which amount
is reflective of the fair current market value of such tract or
parcel; and
WHEREAS, the said sum of Eight Thousand Six Hundred Dollars
($8,600.00) properly should be forthcoming to and payable to
Ramsey County, but to facilitate transfer of the aforementioned
tract or parcel to the State of Minnesota, it appears that the
easiest procedure to follow is to provide for a modification of
the existing agreement between the City and the County dated the
18th day of November, 1963, whereby the City would retain title
to the tract described as:

RESOLVED, That-upon concurrence by resolution of the Board
of County Commissioners of Ramsey County with the terms, provisions
and conditions as set forth in this,resolution, the agreement between

the City of Saint Paul and the County of Ramsey dated the 18th
day of November, 1963, is modified to the extent hereinbefore
provided; and be it
FURTHER RESOLVED, That upon such concurrence by the Board
of County Commissioners of Ramsey County, the proper City officers
are hereby authorized and directed to convey the tract or parcel
in which the State is interestadto the State of Minnesota; and
be it
FINALLY RESOLVED, That upon receipt of the sum of Eight
Thousand Six Hundred Dollars ($8,600.00) from the State of
Minnesota, such amount shall be credited by the proper City
officers against the remaining balance due and payable from the
County of Ramsey pursuant to the provisions of the agreement dated
the 18th day of November, 1963.

The option referred to in the attached Resolution granting the
State of Minnesota the right to purchase a small irregular par-
cel of land located in the vicinity of the southeast corner of
Burns Avenue and McKnight Road has been reviewed by this office.
The consideration for the property of $8,600.00, the amount of
the'State's certified appraisal, reflects the current fair mar-
ket value for this property.
This small parcel being acquired by the State for highway pur-
poses "is a part of the tract of property being conveyed by the
City of St. Paul, the record fee owner, to Ramsey County, the
contract purchaser, under an agreement dated November 18, 1963.
To facilitate the transfer of property to the State, we request
your consideration and approval of the attached concurring reso-
lutions.,.
