This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "All Residence District to "Commercial" District, to wit: Lots 1 through 17, Block 20, Gurney Highland Park, and Lots 10 through 159 Block 19, Gurney Highland Park, also vacated Nebraska Avenue adjoining Blocks 19 and 20 of said Addition; I located bn the west side of Jackson Street between Hoyt and Arlington Avenues in the City of Saint Paul, Minnesota., Sec. 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health, and safety. Sec. 3. Gerber, Jr. City Clerk Building Dear Sir: The City Council referred to the Board of Zoning the petition of Bernard Pfefer to rezone from "A" residence toi commercial property located on the west side of Jackson Street between Hoyt -and Arlington Avenues. The pro- perty is described as,Lot 1 thru 17, Block 20, Gurney's Highland Park, and Lots 10 thru 15, Block 19, Gurney's Highland Park, also vacated Nebraska Avenue adjoining Blocks X19 and 20, of said addition. In a letter dated August 25, 1965, the Commissioner of Finance reported the petition sufficient with the owners of',-8 of a= possible 11 (approximately 72.72 %) tracts.of land within the prescribed 100 foot'radius having signed the petition. The.site'is presently vacant ,and in a letter dated September 3, 1965, addressed to the Mayor and Council, the applicant stated that the purpose of the rezoning is to develop.the-site into a retail establishment, housing primarily a grocery supermarket and secondarialy a-laundry and dry cleaning drive -in. The Board of Zoning considered'this matter at its regular meetings on September 16, 1965 "and October 8, 1965." The staff reported that the pro- perty under consideration is a large irregularly shaped tract of land with 432 foot frontage along Jackson Street,, and 133.5 feet along Wanda Street resulting in an area of approximately 91,860 square feet. The adjacent land uses are as follows; north is a single - family residence, farther north another single - family residence and a church; to the east across Jackson Street is-the Housing and Redevelopment Authority McDonough Housing Project; to the south, the Water Works right -of -way and vacant land; west is the Water Works right -of -way and vacant land which is low and boggy. The Board considered the uses in the immediate area, the existing zoning, the develop - ment of the land south of Arlington Avenue and east of Jackson Street which includes a fairly recent second -hand motor parts dealer yard and other salvage yards, and the large number of families living in the McDonough Housing Project area. Based upon the area uses and the zoning of these properties, the Board of Zoning recommends the approval of the petition to rezone from "A" residence to commercial the above described property. 1.
