PAUL COUNCIL NO OFFICE OF THE CITY CLERK FILE COUNCIL RESOLUTION— GENERAL FORM PRESENTED BY COMMISSIONER G 2z5 98 RESOLVED, upon the pertinent appeal under the Zoning Code by Harry Gutowich and Helen Gutowich, as owners of the subject property situate in the City of Saint Paul, described as Lot 15, Block 2, Palace Addition to St. Paul, located on the southeast corner of Ashland Avenue and Avon Street, that the provisions of said Zoning Code hereby are determined and varied in applica- tion so that the premises may contain separate accommodations for several, not in excess of three families, provided that the con- tinuance of such thre6- family dwelling be for the remaining life of-the structure now on said premises, and provided further, that the appellants comply with the changes set forth in the Bureau of Public Buildings and Housing Code Division report dated July 22, 1965, and provide off street parking for three .vehicles, and -provided further, that such,permission shall lapse ipso facto-unless the appellants are in full compliance with the above report, dated July 22, 1965, within one year from the date of this resolution, acceptance of which fesolution and terms to be made-by the appellants, and - subject to compliance with said provisions the Council expressly finds that such relief will be consistent with the public health and general welfare, and that said relief and permission herein granted is subject to the further condition that the appellants and their successors and assigns otherwise shall make due compliance with all applicable provisions of Municipal-Ordinances, State Statutes, rules and regulations of public authorities having cognizance; further, -that a copy of this Resolution be filed with the Register of Deeds in and for Ramsey County, Minnesota. Only one unit is being rented at this time, and we under- stand that we cannot rent the other unit until such time as proper action is taken by your body to allow three family use. Gerber City Clerk Building Dear Sir: This is in the matter of the appeal of Harry and Helen Gutowich to legalize a three - family use in a "B" residence district for property located at the southeast corner of Ashland-Avenue and -Avon Street which is described as Lot 15, Block 2, Palace Addition'. In 1897 the subject property was,developed•with the existing structure con- structed as a single or two - family =residence. At some unknown date the use of the structure was extended to a three - family dwelling which did not necessitate an enlargement of the original structure. Because the property is classified as "B" residence which limits it to a two - family use, the applicant must secure Council authorization to continue the use of the property as a three-p!6-x. The Board of Zoning heard this request on August 5, 1965. It was the Board's finding that inasmuch as off - street parking for three cars can be provided_, that the appeal to "continue the three- amily use be granted sub- ject to compliance with the changes set forth in the Bureau of Public Buildings and Housing Code Division report „dated July 22, 1965 a copy of which is attached. It is therefore, the Board of Zoning's recommendation that the use of the `subject property be continued as a three -plex for the life of the structure subject to the above. conditions.
