OIL RESOLUTION — GENERAL FORM
RESOLVED, upon the pertinent appeal, under the Zoning
Code, by Janet S. Pierre, as owner of the subject premises
situate in the City of Saint Paul, described as Lot 15,
Auditor =s Subdivision No. 72, located on the east side of
Bates Avenue between E• 7th Street and 6th Street, that
the provisions of said Zoning Code hereby are determined and
varied in application, as necessary therefor, and a special
permit hereby is granted unto said appellant and her successors
and assigns, for the reconstruction of the two - family residence
structure presently, and since the year 1880, maintained thereon,
in respect of the interior of the same and so that the same
shall contain separate accommodations for not in excess of
three families, said existing structure having a gross ground
area delineated by its foundation walls, of at least 1000
square feet, and it being hereby found and determined that
such relief is consistent with the public health and general
welfare and the attainment of the general objectives of said
Zoning Code; provided, however, that said permittee shall
provide three off- street parking spaces in connection with
said property and shall comply, otherwise, with all the
Building and Housing Code requirements for a three Alex.

This is written in reply�to the referral of the appeal of Janet S. Pierre
to convert a two - family residence to a three -plex in a "B" residence
district on property located on the east side of Bates Avenue between East
Seventh Street and Sixth Street. The property is described as Lot 15,
Auditor's Subdivision No. 72.
The -site is developed with a two and one -half story frame two - family
residence which was constructed in 1880. The applicant proposes to remodel
and add another apartment on the second floor. Because the property is
classified as "B" residence which normally limits its use to single - family
and two - family dwellings, the applicant must seek Council authorization for
the appeal to.establish a three- family use.

The Board of Zoning met on September 2, 1965 to consider this appeal. The
staff reported that the lot -is -63 feet in width and 158 feet in depth which
results in an area of 9,954 square feet. The Comprehensive Plan indicates
the highest and best use of the..-property would be in the R -7 residential
district which requires a lot of a minimum width.of- 50'Jeet and a minimum
lot area of 6,000,-square'feet. -The adjacent land uses are as follows:
north, a three - family residence and commercial development; east, the rear
yards of industrial development fronting on Seventh Street; south, mixed
one and two - family homes; west, multi - family uses. The staff also reported
that the structure is undergoing extensive remodeling. There is adequate
area to provide a driveway from Bates Avenue for off - street parking for
three or more cars. z
Pursuant to par-2 of subsection o' Section 64.03 of the Zoning Code, and in
consideration that the use.. -of the structure is compatible with the surround-
ing area uses, is in accordance with the Comprehensive Plan, the- lot area
and lot width are adequate; and that the'struct ed_ rior to

I, Janet S Pierre, wish to have the property descrijed as Lot 15,
Auditors Subdivision x}72, which is-located at 406 Bates, between 6th
and 7th St, on e!�st side of street, St Paul, Ramsey County, Minnesota,
rezoned from duplex to three family dwelling.
�,hen I purchased this property, I was under the impression that it
was zoned for a 3 -plex. Upon applying for a building permit, I was
informed that the zoning was for a two family dwelling. This creates
a hardship because the building has been laid out as a 3 -plbx. I make
this appeal under legistative code chapter 64.03, section 0, paragraph 2.
