WHEREAS, Paragraph 1.63 of Section I of the General Specifications
made a part of all local improvements awarded by this Council, un-
less expressly waived, provides for the retention of a- reserve
amount for the purpose of enforcing the provisions of all guarantees
inpmberit upon the Contractor, the same to extend for a period of
o e (1) year from the date of the final settlement for the work, and
WFi REAS, the major physical work, except for t)ie placing of the seal
//coat in the prosecution of that certain improvement described as
the Grading and Paving of MISSISSIPPI RIVER BOULEVARD from the West
City Limits to Pelham Boulevard was completed and opened to traffic
well over, one (1) year ago, and for which the final settlement,
only recently, has been made, and
WHEREAS, in view of the delayed settlement.,-to adhere to the above
Section of the General Specifications would result in an unreasonable
withholding of the reserve amount of $ 11000.00 set up in this
Improvement Contract, known as Comptroller's Contract L -6657, since
no amount has been expended by the City for any maintenance or repairs'
thereto; therefore, be it
RESOLVED, that the. foregoing reserve amount in the sum of 15000.003
provided for in said contract, Comptroller's Contrec t L-60 657, be and
the same is hereby released and the •McCree Company, contractor for
this project is finally discharged from this contract.
