COMMISSIONER DATE
WHEREAS; in the matter of the Grading and Paving of MISSISSIPPI
RIVER BOULEVARD from the West City Limits to Pelham Boulevard,
Comptroller's Contract L -66575 McCree and Company, contractor,
the specified date of completion is September 15, 1964, and
WHEREAS, the contractor prosecuted the work in a diligent manner,
substantially completing the work to permit its being opened to
traffic on or about said date, save and except for the placing
of the seal coat, which was postponed until the current construction
season, when the weather temperature provided for in the specifica-
tions would manifest itself, with the result that it was not
possible to complete this item of the work by said completion
date,, now therefore, be it
RESOLVED, that the proper city officers be and they are hereby
authorized and directed to execute an amendment to said contract
extending the time of completion to JUNE 24, 1965, provided how-
ever, that this resolution shall have no force or effect unless
P the sureties on the contractor's bond consent thereto in writing
and file such consent with the City Comptroller, aryl be it
FURTHER RESOLVED, that the City of Saint Paul waives all claim for
liquidated damages and that no engineering and inspection costs
on this project will be charged to said contractor on account of
such extended period.
