WHEREAS, James Mahoney, an employee of the Department of
Public Safety, Bureau of Police, was injured in a third ,party
accident on November 15 , 1961, while engaged in the performance
of his duties for said Bureau; and �
WHEREAS, the City has incurred medical expense in the
amount of $31.50 therefor, and said employee was disabled from
work for a period of time, being paid salary in the amount of
$141.28 therefor; and i
WHEREAS, a settlement has been negotiated between said
employee and the other' party involved in said accident, �in the
total amount ` of $172. 78, and out of said sum� the City will re-
ceive the full amount of i��s subrogation interest by reason of
injury to its employee, $1742.78, less one-third as attorneys
fees, $57.59, or a net settlement to the City of $115. 19, now,
therefore� be it
RESOLVED� That the proper City Officers are hereby auth-
,orized to accept in full final, and complete settlement of its
claim herein the sum of �115. 19 and to execute any necessary
releases- therefor; that of said sum, $94.19 is thereby credited
to the Police Salary Fund; and �21.00 to the Workmen's Compen-
' sation �nd.
