WHEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City
Council to hold public hearings to consider the advisability of revoking the rental registration certificate
for a single family rental property located at 1186 DULUTH ST and registered to Harvey J. Thunborg;
and
WHEREAS, on June 23, 2005, NHPI conducted an inspection of said property and issued a
Summary Abatement Order with a compliance deadline of July 1, 2005; and
WHEREAS, on July 19, 2005, NHPI conducted a reinspection of said property and found lack of
compliance with the previous order; and
WHEREAS, on August 14, 2005, NHPI sent the holder of the rental registration certificate for
the subject property, Harvey J. Thunborg, a$50 excessive consumption bill, addressed to 1192
Mimiehaha Ave W, St Paul MN 55104-1404, the address on said certificate; and
WHEREAS, as of October 12, 2005, said $50.00 has not been paid, and Legislative Code §51.06
(a) (v) provides that non-payment of fees for excessive consumption is grounds for certificate revocation;
and
WHEREAS, on August 19, 2005, NHPI notified Harvey J. Thunborg of the need to arrange an
interior inspection of the subject property, and
WHEREAS, as of October 12, 2005, an interior inspection has not been arranged, and Legislative
Code §51.07 (a) (in� provides that the imposition of an excessive consumption fee is grounds for an
interior inspection; and
WHEREAS, on September 23, 2005, NHPI sent Harvey J. Thunborg the proper Notice of Intent
to Revoke Rental Registration (copy attached); and
WHEREAS, Harvey J. Thunborg has not appealed said notice and the time for filing an appeal
has expired; now therefore
BE IT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the
following findings and order concen�ing the subject property at 1186 DULUTH ST .
1. That the subject property is a single family rental property that is required to be registered
with the City's Rental Registration Program

That the holder of the Rental Registzation Certificate for the subject property is Harvey 7.
Thunborg.
That said certificate holder has been billed for excessive consumption of code inspection
services, which has not been paid.
That said certificate holder has been requested to allow an interior inspection ofthe
subject propetty, which has not been arranged.
That the notification requirements of Chapter 51 have been fulfilled and the time for an
appeal has expired without an appeal being made.

The abov�referenced Rental Registration Certificate issued to Harvey J. Thunborg for the
single family rental property at 1186 DULUTH ST, Saint Paul, NIN is hereby revoked.

I am writing to you in your capacity as the holder of a rental registration certificate for 1186 DLTLUTH ST, St.
Paul MN.
You aze hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paul Legislative
Code, of the City's intent to revoke the registration certificate for 1186 DULiJTH ST based on the following:
On June 23, 2005, this department wnducted an inspection of said property and issued a

On July 14, 2005, this department conducted a reinspection of said property and found lack of
compliance with the previous order.
On August 19, 2005, this department sent you a$50.00 bill for the cost of said reinspection.
As oftoday this $50.00 has not been paid.
On August 19, 2005, this department notified you by mail of the need to arrange an interior
inspection of said rental property.
As of today this interior inspection has not been arranged.
I have referred this matter to the St. Paul City Council with a recommendation to revoke the rental registration
certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of
this notice. An appeal may be filed pursuant to legislative Code §18.02, by appearing in person between the
hours of 8:00 a.m and 4:30 p.m on any business day at the City Clerk's Office, Room 110, City Hall, 15 W_
Kellogg Boulevard, St. Paul, MN or you may appeal by mail within the same 13 day time line.

Once the City Council has revoked the rental registration certificate, occupancy ofthe property is not allowed
until (1) an inspection by Neighborhood Housing and Property Improvement (NHPI) has been conducted, (2) the
Director of NHPI has determined the property to be in compliance, and (3) the certificate is renewed. Note:
Renting a property without a certificate is a misdemeanor.
Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City
Council acts to revoke this certificate. If all issues aze addressed, I will recommend that the revocation be
withdrawn from consideration by the City Council.
