accessory to a proposed 85 unit anartment development on the south 310
feet of the subject property. The property under consideration is located
' , � on the east side of Hazelwood Street between Maryland and Ivy Avenues. . The _

The Board of Zoning considered�this ,matter at its regular meeting on
'November 5, 1964. The staff reported that� Hazelwood Street which ad-
_ joins the subject property on the west is unimproved, and that before
� developing the subject property for any use, it would be necessary to
` grado and s_urface Hazelwood S�eet�. This finding is concurreei i� by the �
Traffic Engineer. It should•be poi�nted out that of the 363.9 feet along
� the south property line of the subject property, only 150 feet of said .
sideyard actually adjoins land classified in the commercial district.
At the Board`s hearing, the staff pointed out that ,in its opinion, con- `
sideratiou_should be given to the proposed apartment development under '
� procedures of the rezoning through consent petition rather than upon the .
° basis of extending a commercial district boundary to an "A" residence dis-
- t rict. T.his was based upon the present commercial zoning of the property
to the south involving 22,500 square feet and the subject property presently
a�ned "A" residence consisting of 177,474 s�uare feet. The Board concurred
� in this report of the �staff. Tlie Board also found that the proposed use
_ of the property is in �conflict with the Comprehensive Land Use Plan which
indicates that its highest and best use would be for singke-family residential
purposes. T�his property has no apparent physical deficiencies which would
- prevent it from being so developed. . -
After hearing the applicant and the staff report, and taking into con-
sideration the highest and best use of the subject property based on the
Comprehensive Plan and all other consideration�, it is the Board's re-
commendation that the appeal and permit be denied. � � �'"

John G. Bouthilet and L. J. Tieso do hereby apply to the
Honorable Mayor and City Council in the nature of a zoning
appeal for a special use permit under Legislative Code
Chapter 6403, Section L, Paragraph 2, in order to construct
5 17-unit mu�.tiple residence buildings , togetlier with 91
parking spaces on the above captioned property. The
premises are presently unoccupied and lying immediately
North of the Superamerica Gas Station site which is zoned
commercial and is contiguous to the subject parcel.
Favorable action of the City on this appeal is needed in
that the premises are presently zoned residential, and with
the apartment construction across Maryland Avenue, the
• commercial gas station site contiguous with the property,
and the cemetary directly across Hazelwood Avenue from the
premises, favorable action on the appeal is needed to develop
the property as an apartment site--the site, for the reasons
• just given is not conducive to one-family residence develop-
ment.

Gentlemen:
Whereas , the legal description relating to the
zoning appeal on the captioned matter has from time to time
been discussed with the planning comm.ittee and the city
planning office and whereas, on January 13, 1965 the city
planning office and the applicants have f inally resolved that
all parties are best served by thelegal description being
again clarified at this time. Please disregard any alterations
or representations of legal descriptions as to the zoning
appeal in connection with the October 21, 1964 request, which
legal description differs in any manner from the legal
description as follows, to-wit:
