1 WI�REAS, the City of Saint Paul, Division of Parks and Recreation, owns the property on the
2 Mississippi River lrnown as Harriet Island; and
4 WHEREAS, due to the silting of the harbors at Harriet Island, as well as the City's shoreline
5 renovation project at Harriet Island there is currently a need to remove and store dredge materials from the
6 river; and

8 WHEREAS, the Saint Paul Port Authority owns property adjacent to City owned property located
9 near the High Bridge which would be a convenient location far the storage of the dredge materials; and

11 WHEREAS, the Port Authority is willing to lease the property to the City for temporary dredging
12 storage for $1.00 and the promise of indemnification; and

WfiEREAS, the City Council finds that the expenditure of public funds, which includes the
promise of indemnificarion, for such a purpose will facilitate and enable the City to remove silt and
continue the shoreline renovation project at Harriet Island; now, therefore, be it
RESOLVED, that the City shall indemnify and hold hannless the Saint Paul Port Authority for any
and all claims, losses, damages, causes of action, liabilities, judgments, fines, penalries, costs and expenses
arising as a result of, or in any way relating to, the starage of dredged material on the Port Authority
Property, excepting damages which arise from hidden traps or conditions exisring on the premises of wYuch
the Port Authority had actual or conshuctive notice or injuries arising out of criminal actions by third
parties. Nothing in the foregoing indemnification shall be constxued as a waiver of the municipal tort
liability limits set forth in Minn. Stat. §§466.01 et. seq.
