05-960Council File # �.. / (C�C/ Green Sheet # 3028433 RESOLUTION SAINT PAUL, MINNESOTA Presented By �\ \� Referred To Committee: Date 2 Whereas, Ann Brownlee, d/b/a the Grand Avenue Veterinary Center at 1140 Crrand Avenue 3 desires to make an application to the City for variances and building permits necessary to 4 undertake the expansion of the building housing the said business on property legally described 5 as MANSON AND SIMONTON'S ADDTTION TO ST. PAUL, IN RAMSEY COUNTY, 6 MINNESOTA, LOT 10 BLK 4; and 8 Whereas, the proposed building expansion will not require variances as the expansion will 9 comply with existing height and setback limits. However, the expanded building will require 10 additional off-street pazking. The property does not have sufficient space for the additional off- 11 street parking. Therefore, in order to undertake the building expansion, a variance of the off- 12 street pazking requirements is necessary; and 13 14 IS 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 3? 38 39 Whereas, the Council of the City of Saint Paul, in Council File No. OS-875 initiated the process to adopt an interim ordinance imposing a moratorium on the issuance of variances and bui]ding permits along a certain stretch of Grand Avenue including the said property described above; and Whereas, Ann Brownlee had previously applied for an off-street pazking variance application for the said property before the interim ordinance had been introduced. However, the moratorium came into effect before the variance could be reviewed. Accordingly, the variance request was denied because of the moratorium; and Whereas, the said moratorium provides that the Council may amend the interim ordinance and grant exceptions to the moratorium for the puipose of aliowing new, permitted uses within an existing building; and Whereas, the Grand Av,enue Veterinary Center is a use first permitted on the lot in question. The lot has been used for a veterinary clinic for at least twenty yeazs. Constructing an addition to an existing building housing an established and permitted use which do not require area or dimensional variances is in keeping with the vision for the future of Grand Avenue as evidenced by the recent endorsement of the proposed expansion by the District 16 Neighborhood Council. Accordingly, it is reasonable that the City consider an application for an off-street parking variance that is necessary in order to undertake the proposed expansion of the veterinary clinic building; Now, Therefore, Be It Resolved, that the Council of the City of Saint Paul intends to amend the interim ordinance in Council File No. OS-8'75 in order to permit the applicarion for an off-street parking variance for the said property described above; and 05 -9�0 � 2 Be It Finally Resolved, pursuant to this Resolution, that Ann Brownlee, or any other person with 3 an interest in the said property described above, may apply for an off-street pazking variance and 4 building pernvts for an expansion of the veterinary clinic on the said property and have the said 5 applications processed in accordance with the intent of this Resolution, pending the effective date 6 of an amendment to the said interim ordinance that permits the same.
