1 WHEREAS, Neighborhood Housing & Property Improvement has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking and
3 removal of a two-story, wood frame, single family dwelling and the detached, one-stall, wood frame gazage
4 located on property hereinafter referred to as the "Subject Property" and commonly known as 81 Stevens

WHEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Neighborhood Housing & Property Improvement on or before January 9, 2005, the following
are the now known interested or responsible parties for the Subject Property: Raymond Thomas, 323 - 17`�

WE�REAS, Neighborhood Housing & Property Improvement has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate
Nuisance Building(s)" dated June 9, 2005; and
WF�REAS, this order informed the then known interested or responsible parties that the structure
located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by July 11, 2005; and
WF�REAS, the enforcement officer has posted a placard on the Subject Property declaring this
building(sj to consritute a nuisance condition; subject to demolition; and
WF�REAS, this nuisance condition has not been corrected and Neighbarhood Housing & Property
Improvement requested that the City Clerk schedule public hearings before the Legislative Hearing Officer
of the City Council and the Saint Paul City Council; and
WF3EREAS, the interested and responsible parties have been served noUce in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the
public hearings; and

WHEREAS, a hearing was held before the I.egislative Hearing Officer of the Saint Paul City
Council on Tuesday, September 20, 2005 to hear testimony and evidence, and after receiving testimony and
evidence, made the recommendation to approve the request to order the interested or responsible parties to
make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and
remove its blighting influence on the community by rehabilitating this structure in accordance with all
applicable codes and ordinances, or in the altemative by demolishing and removing the structure in
accordance with all applicabie codes and ordinances. The rehabilitation or demolition of the structure to be

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October 5, 2005
and the testimony and evidence including the acrion taken by the I.egislative Hearing Officer was
considered by the Council; now therefore
BE TT RESOLVED, that based upon the testimony and evidence presented at the above referenced
public hearings, the Saint Paul City Council hereby adopts the following Findings and Order conceming the
Subject Property at 81 Stevens Street West:

That the Subject Property comprises a nuisance condition as defined in Saint Paul
LegislaUve Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollazs ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then lmown responsible parties
to conect the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nnisance condition have not been corrected.
That Neighborhood Housing & Property Improvement has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been rou6nely monitored by Neighborhood Housing & Property
Improvement, V acantlNuisance Buildings.
That the known interested parties and owners are as previously stated in this resolution and
that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property safe and not
detrimental to the public peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure and conecting all deficiencies as prescribed in the above
referenced Order to Abate Nuisance Building(s) in accordance with ail applicable codes and
ordinances, or in the alterna6ve by demolishing and removing the structure in accordance with all
applicable codes and ordinances. The rehabilitation or demolition and removal of the structure
must be completed within ��F-�� �.,-� after the date of the Council Hearing.

2. ff the above corrective action is not completed within this period of time Neighborhood Housing &
Property Improvement is hereby authorized to take whatever steps aze necessary to demolish and
remove this structure, fill the site and charge the costs incurred against the Subject Property
pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
property or fixtures of any kind which interfere with the demolition and removai shall be removed
from the property by the responsible parties by the end of this rime period. If ail personal property
is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and
dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in
accardance with Chapter 45 of the Saint Paul Legislafive Code.

Neiahborhood Housing & Progerty Improvement has declared this buildin�(s) to constitute a
"nuisance" as defined by Legislative Code, Chapter 45. Neighborhood Housing & Property
Improvement has issued an order to the then known responsible parties to eliminate this nuisance
condition by correcting the deficiencies or by razina and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Neighborhood Housing & Property Improvement that the City Council
pass a resolution ordering the responsible parties to either repair, or demolish and remove this
building in a timely manner, and failing that, authorize the Neighborhood Housing & Property
Improvement to proceed to demolition and removal, and to assess the costs incuned against the
real estate as a special assessment to be collected in the same manner as taxes.

comprises a nuisance as defined by the legislative code. The City has had to board tlus building to
secure it from trespass. The Vacant Building Registration fees aze not paid as of 9-20-05.
Taxation has placed an estimated mazket value of $64,400 on the land and $259,100 on the
building. A Code Compliance Inspection was last completed on 7-4-05. A bond has been posted.
Code Enforcement Officers estimate the cost to repair is $75,000 to $80,000. The estimated cost
to demolish is $10,000 to $11,000. The owner has pulled electrical and plumbingpermits. An
electrical contractor was at the property.
Jonathan Liang, 1882 Feronia Avenue, appeared and stated this properry has been a neighborhood
nuisance. He has lived in the neighborhood for seven yeazs. The property has been in and out of
occupancy. Based on the owner's actions, he demonstrates a contempt for the neighbarhood in the
way he treats the properiy and the shoddy work he displays. Mr Liang has a lack of confidence in
the owner's ability to do the right thing.
Aazon Frase, 1900 Feronia Avenue, appeazed and stated he has been here for 2 years. When they
were looking for houses nt the neighborhood, he walked up to the house and thought about not
going inside. There were many things wrong on the interior: stained carpet and floors, broken
toilet, leaks in the roof, etc. It appeazed to be vacant. The things that were done haue been done
to the minimum. For example, a storm door was put on the front without a door closure, so the
door flops in the wind. Three windows in the front have been replaced, but they are not the right
size for the opening, so there is raw wood to fill in the gap. That is just another example of low
quality effort that goes into the home.
Steve Magner stated that the maintenance has been shoddy.
Ms. Moemond recommends laying over to the September 27 Legislative Hearing.
Resolution ordering the owner to remove or repair the building(s) at 81 Stevens Street West.
If the owner fails to comply with the order, Neighborhood Housing and Property
Improvement is ordered to remove the buffding(s).
Steve Magner reported this single-family dwelling that has been vacant since 7-20-04. The
current owner is Williams Renovarions II. Michael Williams said that he just purchased the
property 30 days ago. He owns Wililams Renovations and Regal Designs. Williams Renovations
is used to rehab houses and Regal owns the building.
Mr. Magner continued: The property was fire damaged. There have been seven Suminary
Abatement Notices issued to remove debris, scrap wood, household items, rubble, remove snow
and ice, and remove tires. On 5-31-05, an inspecfion of the building was conducted, a list of
deficiencies which constitute a nuisance condition was developed, and photographs were taken.
An Order to Abate a Nuisance Building was posted on 6-10-OS with a compliance date of 7-11-05.
As of this date, this properiy remains in a condition which comprises a nuisance as defined by the
legislafive code. The City had to secure the property from trespass. The Vacant Building
Registrarion fee has been paid. A Code Compliance Inspection was completed on 8-18-OS and a
$2,000 bond was posted. Code Enforcement officers estimate the cost to repair is $75,000 to
$80,000. The estixnated cost to demolish is $8,000 to $9,000. They have obtained their permits

and bave started warking on the property. There was an issue with the bond. The bond was there
or supposed to be put in and it was not. Mr. Williams responded it got worked out the sasne day.
Ms. Moermond stated it sounds like the owner l�ows what he is doing, which she likes to see.
She would like a statement of what he plans to do in the rehab. Mr. Williams responded he would
like to make a copy of the Code Compliance Report and add dates indicating when the items are
completed or will be done.
Ms. Moermond asked if he had the financial wherewithal to do the work. Mr. Williams responded
that he takes out loans for every property
Ms. Moermond asked how much time he needs. Mr. Williams responded "120 days."
Ms. Moermond recommends granting the owner 120 days on condition that a work plan is
submitted by noon of October 5, 2005. Mr. Magner stated the work plan needs to include a
completion date next to each item on the Code Compliance Inspection Report.
Resolution ordering the owner to remove or repair the building(s) at 441 Universitv Avenue
West. If the owner fails to comply with the order, Neighborhood Housing and Property
Improvement is ordered to remove the building(s).
Steve Johnson, representative for the ownex, BSI Construction, appeazed and stated they are
looking at putting up a new building at this location. It will be a pre cast structure. It will be in
December when the panels arrive and they start the construction. They are looking at a mid
October construction for the start up for the foundation and drain tile system. He is just acting on
the notice on behalf of the owner.
Steve Magner reported this is a two story brick building and has been vacant since 12-6-04. The
current owner is Hoang Pham. The owner originally discuss he was going to obtain a demolition
permit and it was going to be demolished in the spring 2005. There were two sununary abatement
notices to remove a lazge piece of tin from the roof and loose brick from the building. On 5-16-
O5, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance
condition was developed, and photographs were taken. An Order to abate a nuisance building was
posted on 6-2-OS with a compliance date of 6-17-05. As of this date, this property remains in a
condition which comprises a nuisance as defined by the legislative code. The Vacant Building
Registrafion fees have not been paid as of today. Tasation has placed an esrimated market value
of $54,800 on the land and $209,200 on the building. A$2,000 bond has not been posted. Rea1
Estate taxes are delinquent in the amount of $4,494. Code Enforcement offices estimate the repair
to be $20�,OQQ to $250,000. The estimated cost tA demolish is $45,000 to $65,OQ0.
Mr. Magner stated that the building is a nuisance and has a dilapidated structure. 'I'here aze a lot
of concerns and complaints from the neighborhood and other factions of the City. Mr. Magner has
spoken to Mr. JoYmson and been appraised that this demolition would occur and permits would be
taken out. Originally, he said it was not a problem. NHPI held out on this hearing process for
that, but it hasn't happened. NHPI is seeking a resolution to get a commitment out of the owner to
