2 WHEREAS, Chapter 293 of the Saint Paul I,egislarive Code was enacted to regulate the subject of noise in
3 the City of Saint Paul; and

5 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in
6§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
8
9 WHEREAS, the University of St. Thomas, represented by Amy Graff, Assistant Director of Campus Life,
10 who has been designated as the responsible person on the application, has applied for a variance to allow live music
11 at 2115 Summit Ave.; and
12
13 WHEREAS, applicant is seeking a variance for the hours of 6:30 p.m, to 930 p.m. October 14, 2005; and
14
15 WHEREAS, if applicant is not granted a variance it will not be able to present amplified sound for their
16 country music concert; and
17
18 WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application
19 and has made recommendations regarding conditions for the variance; now, therefore, be it
20
21 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to the University of St.
22 Thomas, subject to the following conditions:

24 1) The variance shall be for the hours of 6:30 p.m. to 9:30 p.m. for October 14, 2005.

26 2) All electronically powered equipment used in conjunction with the event shall not
27 exceed 95 dBA as measured from the closer of 50 feet from the noise source or the
28 sound mix.

1 3) The applicant shall provide personnel and equipment who shall provide continuos b � q'r _
2 sound level monitoring beriveen 6:30 p.m. and 9:30 p.m. on the date to ensure �Q
3 compliance with Condition #2.

5 4) All electronically powered equipment, PA systems, loudspeakers or similaz devices shall
6 be huned off no later than 9:30 p.m. on October 14, 2005.
