Street to Rankin Street, Comptroller� s Contract L-6i76-27, ���bach Construction Compar_y, contractor, -the specified date of- completion � is June 15, 196�}., and WI�REAS, the Contractor has prosecizted the work diligently, but due to additional excavation for the widening of the roadway in the deep cut area of the Short Line Road, to provide for the merging of traffic in an emergency escape lane at the Hamline �ivenue approach, and which widening necessitated the erection of a retaining wall for slope protection, it was not possible to complete said contract by said date of comple tion, theref ore be it . '� RPSOLVID, that the proper city officers be and they are hereby author- ized and dir-ected to execute an amendment to said contract extending the ti� of completion to OCTOBER 12, 1961.�, provided however tha.t this resolution shall have no force or effect unless the sureties on the contractor' s bond consent thereto in writing and file such con- sent with the C3ty Comptroller, and be it ��� FURTHER RESOLVED, That the City of Saint Paul hereby waives all claim � for liquidated damages and that no engineering and inspection costs shall be charged to the Contractor on ac count of this extendecl period.
