Section 2. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 3. Marshall City Clerk Building i Dear Sir: This is written in response to the Petition of Charles P. McCann and William E. Steinworth to rezone from "B" Residence to "C" Residence - property located on the North side of Minnehaha Avenue between Snelling Avenue and Fry Street, described as Lot 15, Block 9, College Place West Division. This matter was considered at the May 5, 1966 Board of Zoning meeting. The property has 60 feet of frontage on Minnehaha Avenue and an area of 10,559 square feet. The property is to be combined with Lots 16 and 17 adjoining to the East and a 30 -unit apartment building con- structed upon the three lots. The area uses are as follows: North, single - family; East, one, two and four - family; South, single - family; and East a rest home and farther East along Snelling, Commercial. The area zoning is as follows: North, West and South, "B" Residence; East "C" Residence which was rezoned in 1949 for the rest home; and farther East along Snelling Avenue, Commercial. It was the findings of the Board that it would be reasonable to grant the petition since the rezoning would be an expansion of an existing "C" Zone to the East, and since there seems to be no reasons to draw the line between "B" Zoning and "C" Zonirvg at two lots rather than three. Moreover, a 30 -unit apartment constructed on three lots would not be any more of a change in the character of the area than if an apartment were to be built on the two existing "C" zoned lots.
