WHEREAS, the Office of the Corporation Counsel has
certified in writing that it is in doubt as to who is en-
titled to the award of damages, in the amount of $30.00,
for the taking -of the following described easements
An easement in the land necessary for slopes,
cuts and fills including right of removal of
lateral support from subject land or remainder
thereof occasioned by excavations thereof:cr con-
struction of slopes in the grading of the alley in
the following: Lot 6, Block 3, Oakland Park Addition
to St.-Paul, said easement being in the land along the
south line of the tract described and immediately
adjacent to the north side of the alley, to be of
variable width but not to exceed a maximum width of
2 feet, according to the plat thereof on file and
of record in the office of the Register of Deeds in
and for Ramsey County, Minnesota;
said award having been confirmed by Council File No. 204300,
approved October 11, 1961, now, therefore, be it
RESOLVED, That a warrant be drawn for said sum of $30.00,
payable to E. J. Fitzgerald, Clerk of District Court, Second
Judicial District, Ramsey County, Minnesota, for the party
or parties entitled thereto.
