RESOLVED, That upon and pursuant to the pertinent appeal,
under the Zoning Code, by D. F. Nolde, owner of the subject real
estate, situate in the City of Saint Paul and described as:
Lot 13, except the east 10 feet adjacent and parallel
to the east line thereof, Block 21, Beaver Lake
Heights;
that the provisions of said Zoning Code hereby are determined
and varied as and to the extent necessary therefor and the
lot area requirements for said premises are hereby relaxed so..
as to accommodate a single - family house, subject to the condition
that said appellant, and his successors and assigns, otherwise,
shall make due compliance with all applicable provisions of
municipal ordinances, State statutes and rules and regulations
of public authorities having cognizance.

This is written'in response to the Appeal of D. F. Nolde
to relax the lot' area requirements on property located
in an "A" Residence area. The , property is located on
the east side of Nokomis Avenue between Reaney 6 Bush
Streets, described as Lot 13, except the east 10 feet
adjacent and parallel to the east line thereof, Block 21,
Beaver Lake Heights. -
This matter was considered at the April 21, 1966 Board
of Zoning meeting. The applicant wishes to construct a
single - family house on a lot with an area of 4,550
square feet. In an "A" Residence district, a single -
family residence may not be constructed on a lot with an
area of less than 5,000 square feet unless the lot was a
lot of record prior to 1922. The appellant's lot is
deficient by 450 square feet or 9 percent. It was the
findings of the Board that since the deficiency is slight,
it would be reasonable to grant the Appeal. Therefore,
the Board recommends approval of the Appeal to relax the
lot area requirement.

64 inclusive, St. Paul Legislative Code, for permission to construct a
single - family dwelling on a lot of insufficient area, on property described
as Lot 13, except the East 10 feet adjacent and parallel to the East line
thereof, Block 21, Beaver Lake'Heights, located on the east side of
Nokomis between Bush and Reaney.
