RESOLVED, _upon the pertinent appeal under the Zoning Code by
Doris W. Davis as owner of the subject property situate in the
City of Saint Lul, described as Lots 17 and 18, Block 20, Lyman
Daytons Addition to the City of Saint Paul, located at the south-
east corner of Sixth Street and Bates Avenue, that the provisions
of said Zoning Code hereby are determined and varied in ;application
so that the premises may contain separate accommodations for
several, not in excess of three families, provided that the
continuance of such three - family dwelling be for the remaining life
of the structure now on said premises, and provided further, that
the appellant comply with the changes set forth in the Bureau of
Public Buildings and Housing Code Division report dated March 9,
1966, and provided further, that such permission shall lapse ipso
facto unless the appellant is in full compliance with the above
report, dated March 9, 1966, within one year from the date of
this resolution, and provided further, that the appellant provide
a total of three off-street parking spaces for said dwelling,
acceptance of this resolution and terms to be made by the
appellant,and subject to compliance with said provisions-the
Council expressly finds that such relief will be eonsist6t with
the public health and general welfare, and that said relief and
permission herein granted is subject to the further condition
that the appellant and her successors and assigns otherwise shall
make due compliance with all applicable provisions of Municipal
Ordinances, State Statutes, rules and regulations of public
authorities having cognizance- further, that a copy of this
Resolution be filed with the register of Deeds in and for Ramsey
County, Mi esota.

Dear Sir:
This is written in response�to the Appeal of Doris W. Davis to
legalize and continue an existing illegal three - family use on
property classified as "B" Residence. The property is located
on the southeast corner of Sixth Street and Bates Avenue, des-
cribed as Lots 17, 18, Block 20, Lyman- Dayton's Addition.
In 1890 the existing structure was constructed with a ground
area delineated by its foundation of 1,449 square feet. At
some later date the structure was extended without authoriza-
tion to a three- plex:- Because the property is classified as
"B" Residence,.which would restrict it to a two - ,family use,
the applicant must secure'Council authorization under Chapter
64.03, sec. o,.par. 2,of the Legislative Zoning Code to
continue the three - family use.
The Board of.Zoning heard this matter on April 21, 1966. It
was the Board's finding that it would be reasonable to permit
the three - family use to continue for.the remaining life of the
structure provided that the applicant comply with the changes
as set forth in the Bureau of Public Buildings & Housing Code
Division report dated March 9, 1966, a copy of which is
attached, and further provided that three off -street parking
spaces are developed on the property. It is also the Board of
Zoning's recommendation that, should the Council grant the
Appeal, a copy -of the resolution be filed with the deed to
said property_in the office of the Register of Deeds.

RE: Appeal for authorization of a non - conforming use in a
"B" residential zone at 376 Bates Avenue

The following is a list of items requiring alteration, repair or
removal to meet the minimum requirements of the Housing Code and
Building Code.
1. Install "S" fuses in the electric distribution cabinet.
2. Remove the hazardous and unapproved wiring systems in
the basement and re -wire.
3. In the kitchen of Apt. 1 install an additional wall
outlet.'
4. In the bathroom of Apt. 1 install a wall receptacle and
remove the extension cord wiring.
5. In the small bedroom of Apt. 1 install an additional wall
outlet and repair faulty fixtures.
6. In the kitchen of Apt. 2 remove extension cords used for
wiring and install an additional wall outlet.
7. Install a wall outlet in the bathroom of Apt. 2.
8. Install an additional outlet in the rear bedroom and remove
the cord wiring.
9. Install additional wall outlet in the kitchen of Apt. 3.
10. Remove the cord wiring and install a wall outlet in the
bathroom of Apt. 3.
11. Install a handrail on the upper portion of the rear stair-
well from the.first to second floor.

12. Re- decorate,then repair plaster in the front stairwell
from the first to the second floor.

Dear Sir: With teference to the above talked with your
Planning Boatd and the only objection is the manner in which
she does NOT maintain the yard. Last summer it was left to
grow to weeds never cut and very unsightly. Neighbors
complained ands onee near the end of the season it was cut with
a scythe or some such. Will greatly appreciate this if
same can be called to her attention with emphasis.
