RESOLVED, upon the pertinent appeal under the Zoning
Code by Rudy Kolatz, as owner of the subject property situate
in the City of Saint Paul, described as Lot 10, Block 12,
Nininger & Donnellyts Addition to Holcombets Addition to Saint
Paul, located at the southeast corner of Avon Street and
Hague Avenue, that the provisions of said Zoning Code hereby
are determined and varied in application so that the premises
may contain separate accommodations for several, not in excess
of four families, provided that the continuance of such four -
family dwelling be for the remaining life of the structure
now onsaid premises, and provided further that the appellant
comply with the changes set forth in the Aureau of Public
Buildings and Housing Code Division report dated February 16,
1966, and provided further, that such permission shall lapse
ipso facto unless the appellant is in full compliance with the
above report, dated February 16, 1966, within one year from the
date of this resolution, and provided further, that the appellant
provide a total of four off - street parking spaces for said
dwelling, acceptance of this resolution and terms to be made by
the appellant, and subject to compliance with said provisions?7
the Council expressly finds that such relief will be consist2t
with the public health and general welfare, and that said relief
and permission herein granted is subject to the further condition
that the appellant and his successors and assigns otherwise
shall make due compliance with all applicable provisions of
Municipal Ord3mnces, State Statutes, rules and regulations of
public authorities having cognizance; further, that a copy of
this Resolution be filed with the Register of Deeds in and for
Ramsey County, Minnesota.

This is written in response'to the'Appeal of Rudy Kolatz to legalize
and continue an existing illegal four- family use on property classi-
fied as "B" Residence.. The property is located at the southeast
corner of Avon Street and Hague Avenue and is described as Lot 10,
Block 12, Nininger & Donnelly's Addition. In 1903•the existing
structure was constructed with a ground floor delineated by its
foundation of 1,408 square feet. Atrsome'-later date, the structure
was extended without authorization to,a four -plex. As the property
is classified as "B" Residence which-would restrict it to a one -
family use, the applicant must secure Council authorization under
Chapter 64.03, sec. o, par'2 of,the,Legiaative Zoning Code to con-
tinue the four - family use.
The Board of Zoning heard this request on April 7, 1966. It was
the Board's finding that it would -.be reasonable to permit the four-
family use to continue for the remaining life of the structure
provided that the applicant comply with the changes as set forth in
the Bureau of Public Buildings Z Housing Code Division report dated
February 16, 1966, a copy of which is attached, and further provided
that four off - street parking spaces are developed on the property.
It is also the Board of Zoning's recommendation that, should the
Council grant the Appeal, a copy of the resolution be filed with the
deed to said property in the office of the Register of Deeds.

owned by me on which there are four three -room apartments, all
with full baths. I wish to continue to use this property as it
now exists. The building covers an area of over 1,000 square feet.
I am herewith filing this appeal with you for permission
to maintain not more than a fourplex in this "B" residential area
under Section 6+.03 - 0.2 of the St.Paul Legislative Code.

T16.. the undersigned neighbors wish to protest the appeal to legalize two dwellings in
the Nininger and Donnely Addition called to out attention by letters from your department
numbered File X-94 page 3, and File X"-96; page 4.
We believe this action would be extremely detrimental and would contribute further to
the deterioriation of the Summit —Dale neighborhood which has already been called in the
press and by the City "morally sick "; Mull of the criminal element", and is slated for
federal monies for rehabilitation.
These homes were built to house one and two family dwellings and do not have the necessary
garage, parking, playground, sanitary facilities as bathrooms or fire protection within
themselves to protect their future renters from danger and to protect the neighborhood from
decay caused by these blighting influences.
6Te would,appreciate not only that these zoning consi ptions be denied but further that
a thorough investigation be made into the houses at 'M ONNOW Hkgue which are believed to
be operatirig as multiple dwellings without proper zoning and are examples of the outcome
of cutting up'single family homes into poor multiple dwellings. -
