RESOLVED, upon the appeal of Kraus- Anderson of Saint
Paul Company, for a waiver of the eight(8) foot parking lot
buffer requirement for parking adjacent to residential use,
oh property on the south side of Smith Ave. between W. Kellogg
Blvd. and'Walnut St., described as Lots 5 and 6, Block 53,
Rice & Irvine's Addition, that the provisions of said Zoning
Code, as they apply to off-street parking facilities, are
hereby determined and varied, as and to the extent necessary
therefor, and that said eight (8) foot parking lot buffer
applicable to said premises hereby is relaxed and waived,
subject, however, to the condition that the appellant and
Mr. Sidney Schmuckler (the adjoining property owner to the
southwest) reach a mutual agreement "as to the type of planting
and the cost of the same, to be placed on Mr. Schmucklerts
property along the mutual property line, and that the cost
of the same be shared by the appellant and Mr. Schmuckler,
and in accordance with the revised plans dated July 18, 1965;
and further subject to the condition that said appellant,
and its successors and assigns, otherwise, shall make due
compliance with all applicable provisions of City ordinances,
State statutes and rules and regulations of public authorities
having cognizance._

Gentlemen:
April 6, 1966
Relative to the waive of the normally required parking -
lot buffer on our property adjacent to Mr. Schmuckler's
property we reached an agreement with Mr. Schmuckler several
months ago. It was agreed by Mr. Schmuckler and our company
that trees would be planted on his property and be maintained
by him and that we would pay $150.00 of the original planting
cost.
The trees were planted last fall and we have paid Mr.
Schmuckler the $150.00 as agreed. Attached find a copy of
Schmuckler Construction Company invoice to us for the planting
and a copy of our check in payment of their invoice.
If any further information is required pertaining to this
matter please contact me.
