WHEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City
Council to hold public hearings to consider the advisability of revoking the rental registration certificate
for a duplex rental property located at 472 MINNEHAHA AVE E and registered to Christopher Kenney;
and
WHEREAS, on July 22, 2005 St. Paul Police officers executied a seazch warrant on the above
referenced property. This search warrant was issued on reports of narcotic use and distnbution at 472
Minnehaha Ave. East. On a previous occasion, undercover of�cers were able to buy nazcotics from the
address; and
WHEREAS, On June 3, 2005 St. Paul Police officers arrested resident Steve Gary for obstruction
of legal process. Mr. Gary's arrest stems from a second arrest of an individual at 472 Mirniehaha Ave.
East for consumption of liquor in public and making terroristic threats; and
WHEREAS, on August 24, Z005, NHPI sent Christopher Kenney the proper Notice of Intent to
Revoke Rental Registration (copy attached); and
WHEREAS, Christopher Kenney has not appealed said notice and the time for filing an appeal
has expired; now therefore
BE IT RESOLVED, that based on the foregoing the Saint Paul City Council hereby adopts the
following findings and order concernuig the subject property at 472 MINNEHAHA AVE E.
1. That the subject property is a duplex rental properiy that is required to be registered with
the City's Rental Registration Program.
2. That the holder of the Rental Registration Certificate for the subject property is
Christopher Kenney.
5. That the notification requirements of Chapter 51 have been fulfilled and the time for an
appeal has expired without an appeal being made.

I am writing to you in your capacity as the holder of a rental registration certificate for 4'72
MINNEHAHA AVE ESt. Paul, MN. You are hereby notified, pursuant to the authority granted to
me under Chapter 51 of the St. Pau1 Legislative Code, of the City's intent to revoke the registrarion
certificate for 472 MINNEHAHA AVE E. Based on the following facts I have determined that the
use and occupancy of 472 MINNEHAHA AVE E cvnstitutes a nwsance:
1. On July 22, 2005 St. Pau1 Police officers executed a search warrant on the above
referenced properry. This search warrant was issued on reports of nazcotic use and
distribufion at 472 Minnehaha Ave. East. On a previous occasion, undercover officers were
able to buy nazcotics from the address.
2. On June 3, 2005 St. Paul Police officers arrested resident Steve Gary for obstruction of
legal process. Mr. Gary's arrest stems from a second arrest of a individual at 472 Minnehaha
Ave. East for consumption of liquor in public and making terroristic threats.
I have referred this matter to the 3t. Paul City Council with a recommendation to revoke the rental
registration certificate. The City Counci] will revoke unless an appeal is filed in the next thirteen
(13} days from the date of this notice. An appeai may be fited pursuant to legislative Code § 18A2,
by appearing in person between the hours of 8:00 a.m. and 4:30 p.m. on any business day at the City
Clerk's Office, Room 110, City Ha11, 15 W. Kellogg Boulevazd, St. Paul, MN or you may appea( by
maii within the same 13 day time line.
Once the City Council has revoked the rental registration certificate, occupancy of the property is not

allowed until (1) an inspection by Neighborhood Housing and Properry Improvement (NHPI) has
been conducted, (2) the Director of NHPI has determined the properry to be in compliance with the
ciry code and no longer constitutes a nuisance, and (3) the certificate is renewed. Note: Renting a
properry without a certificate is a misdemeanor.
Piease call me as soon as possibie to arrange a meeting to discnss how to correct this situation before
the City Council acts to revoke this certificate. If aii issues are addressed, I will recommend that the
revocation be withdrawn from consideration by the City Council.
