WHEREAS, in the matters of Comptroller's Contracts L -6780, 6779
and 6670 -A for the Grading and Surfacing of WARREN STREET from
Upper Afton Road to Larry Ho Drive; W1NTHROP STREET from U1,per
Afton .Ro:ad: to Larry Ho Drive and WHITE BEAR AVENUE from Upper
Afton Road to "A" Street respectively' e said con racts pro-
vided for their completion in October, 1965, and
WHEREAS..y: the Armor -Coat Finishing Company, contractor to whom this
work was awarded, prosecuted the construction in a diligent and
assiduous manner to substantially complete the work save and except
the placing of the seal coat which item of work was postponed until
the current construction season when the weather temperature pro-
vided for in the specifications would manifest itself, with the
result that it was not possible to complete these contracts as
specified therein, therefore, be it
RESOLVED, that the proper city officers be and they are hereby
authorized and directed to execute an amendment to said contracts
extending the time of completion for each of them to JUNE 1, 1966,
provided however, that this resolution shall have no force or effect
unless the sureties on the contractor's bonds consent thereto and
t ' filQ,,,such consent in writing with the City Comptroller, and be it
F!!RTHER RESOLVED, that the City of Saint Paul waives all claim for
liquidated damages and that no engineering and inspection costs
on these projects will be charged to said contractor on account of
such extended periods.
