COUNCIL NO. 228919
WHEREAS, in the matter of the construction of Curbing on the
south side of PORTLAND AVENUE from Albert Avenue to Hamline
Avenue, Comptroller's Contract L -6775, Pederson Bros. Company,
contractor, the specified date of completion is October 18, 1965,
and
WUy'REAS, , t . e contractor has prosecuted the work in a diligent
manner, but due to a delay in starting the work, which delay was
cause y the construction of the Portland Ave. portion of the
.Portland- Albert Storm Sewer System, by others, it was not possible
to complete the curb work by said date of completion; therefore,, be it
RESOLVED, that the proper city officers be and they are hereby author4
ized and directed to execute an amendment to said curb contract,
extending the time of completion to JUNE 15 1966, provided however,
that this resolution shall have no force or effect unless the sureties
on the contractor's bond consent thereto and file such consent in
writing with the City Comptroller, and be it
FURTHER RESOLVED, that the City of Saint Paul hereby waives all
claim for liquidated damages and that no engineering and inspection
costs on this project will be charged to the contractor on account
of such extended period.
