BE IT FURTFIER RESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf
of, Northern States Power Company, d.b.a. Xcel Energy (Gas), Xcel Energy Electric,
District Energy St Paul, Inc. and District Cooling St Paui, Inc., Qwest Corporation,
St. Paul Regional Water Services and S� Paul Department of Public Works, made a
part hereof by this reference and filed in the office of the City Clerk of St. Paul, the City, for
itself and on behalf of these corparations and departments, waives the right to the utility
easements in the vacated area described above.
This vacation shall be subject to the terms and condition of Chapter 130, codified March l,
1981, of the Saint Paul I.egislative Code as amended, and to the following conditions:
1. That the petitioner's, their successors and assigns shall pay $1,500 as an administrative fee
for this vacation plus the release of easement rights in other adjacent areas, which is due and
payable within 60 days of the effective date of this resolution.
2. That once the building is removed along the east side of Carleton Street, the petitioner's,
their successors and assigns shall dedicate, in a separate document, an easement for right-of-
way purposes on, over, under and across the westerly five feet of proposed I,ots 1 and 2,
University Carleton Development.

Public Works, made a part hereof by this reference and filed in the office of the City Clerk
of Saint Paul, the City of St. Paul, for itself and on behalf of said City department, waives its
right to any public utility easements held by said City Departrnent, in the block bounded
University Avenue West, Hampden Avenue, Charles Avenue and Carleton Street.
That the petitioners, their successors and assigns agree to indexnnify, defend and save
harmless the City of Saint Paul, its officers and employees from all suits, actions or claims of

Dear Mr. Ortiz:
I am writing in response to your letter of May 24, 2005, in which you requested that
we comment on the referenced vacation; and that we release our easement interest
in the block in St. Paul bounded by Hampden, University, Carleton and Charles.
(THIS IETTER IS MEANT TO SUPERCEDE THAT ONE ftESERV{NG THE
SOUTHEASTERLY 20 FEET OF LASALLE ONLY)
We have no objection to the vacation of the alley running northeasterly from
University Avenue along the lot lines of Lots 54 and 55. We have no electric
facilities in said alley and do not require easement rights therein.
We do, however have overhead distribution poles and line within the vacated part
of LaSalle lying between University Avenue and Charles Street, for which we must
retair. easement rights. In addiiion to serving subject property, these lines also feed
a municipal street light on the northerly side of University Avenue. Rights reserved
in the 1994 vacation for these facilities will not be relinquished until there is no
need for the facilities and they have been completely removed.

Dear Mr. Ortiz:
I have reviewed the following requests received by facsimile on June 3:
a) Vacation of alley in Lot 54 and Lot 55 HewitYs Outlots First Division;
b) Release of easement interest in vacated LaSalle Street; and
c) Release of easement interest in the block bounded by Hampden, University,
Carleton, and Charles.
Xcel Energy gas division has no objection to the vacation of the alley running northeasterly
from University Avenue between Lots 54 and 55. There are no gas facilities in the subject
alley. Attached is the signed Vacation Inquiry Form for the alley only.
Release of gas easements in LaSalle Street between University Avenue and Charles
Avenue is not possible because there are gas pipelines present in the vacated right-of-way
(see attached drawing). Please note that a portion of these gas pipelines serves as a
connection between gas pipelines on University Avenue.
Release of gas easements in the area bounded by Hampden Avenue, University Avenue,
Carleton Street, and Charles Avenue is not possible because there are several gas services
in the subject area.
With exception of the subject alley, gas easement rights can not be released until there is no
need for the gas facilities and the gas facilities have been removed.

AMENDED PETTTION FOR COMPLETE VACATION
OF ALL OF THE CITY'S INTERESTS IN THE WITHIlV LAND
Johnson Brothers Liquor Company, formerly known as Johnson Brothers
Wholesale Liguor Company, a corpararion under the laws of the 5tate of Minnesota
filed its Petition for Alley vacation January 24, 2005 and does hereby amend its
petition to the Council of the City of Saint Paul to vacate its interest in the alley,
utility easements and any other interests the City may have in the land described
below:
The legal description of the alley proposed to be vacated is the
norkh-south alley created by deed dated November 8, 1909, filed
December 27, 1909 in Book 528 of Deeds, page 230, described as
follows:
The easterly 10 feet of Lot 54 and the westerly 10 feet of Lot
55,"Hewitt's Out Lots First Division", Except the northeriy 113
feetthereo£
2. The easements retained in part of vacated La5alle Avenue to protect the
interests of Northern. States Power Company and other terms recorded
February 15, 1995 as Documerit Nusnber 2855928.
3. Any other interests of the City of St. Paul, recorded or unrecorded,
including utility and slope easements, lying within the following
described property:
Beginning at the most Westerly corner of Lot 52, Hewitt's Out Lots 1 st
Division, thence Northeasterly along the said I,ot 52 an assumed bearing
of North 45 degrees 02 minutes 31 seconds East, 310.00 feet; thence
South 45 degrees East, 809.06 feet; thence South 15 de�ees 56 minutes
West, 177.10 feet; thence South 45 degrees 02 minutes 3 i seconds
West, 15512 feet; thence North 45 degrees West, 895.00 feet to the
point of beginning.
2. The reason for the vacation request is that the Ramsey County
Examiner of Tifle's office suggested the City vacate ali of its
interests in the above land and that the petitioner re-plat the above
property and de.dicate to the public the necessary easements in the
new plat. Tfie,petitioner will be responsible for the re-plat and this
vacation.
