negotiations shall be drafted and submitted to this Council,
approved as to form and as to form and execution by the Corporation
Counsel, and approved and authorized by the subsequent resolution
of this Council.
RESOLVED FURTHER, that it is contemplated that any such lease,
among other things, shall impose upon the lessee absolute require-
ments for said lessee's compliance with all applicable provisions
of State and municipal laws pertaining to the,proposed• miniature
railroad and incidental uses upon the right of way, which presently
constitutes a portion of Como Park, a public park of said City.

COUNCIL AESOLUTION— GENERAL FORM
RESOLVED, by the Council of the City of Saint Paul, that
the Commissioner of Parks and Recreation and Public Buildings,
having reported concerning the negotiations for construction
-and operation,of a one- quarter sized scale model steam railroad
in Como Park, and it being hereby found that such a miniature
scale railroad together with rolling stock, road bed, tracks,
ties, switches, underpasses or overpasses, sigral.s, and depots
would be a proper convenience, accommodation, and entertainment
for the enjoyment, use, and recreation of persons visiting the
said Park; that the pending negotiations between said Commissioner
and private parties directed to the leasing of necessary land
and right of way by said City as lessor to a Minnesota corporation
(or partnership) to be formed by said private parties as lessee
for a specific use by said lessee to -wits
'The construction, installation, maintenance, and
,operation on specified portions of park property
a right of way for the use and operation of a
miniature scale railroad within said Park for the
carriage of passengers for fare and incidental
concession privileges hereby are approved and
authorized provided that there shall be no
,expenditure on any such account of any public
funds and that, among other things, any resultant
,lease shall impose upon the lessee the obligation
to pay all costs and expenses incidental to the
,construction, installation, maintenance, and
operation of such proposed scale railroad and
,to pay a minimum rental to said City for the use
of the right of way for each annual seasonal
period in the amount of $1,000.00;
and that no'such lease shall be deemed authorized hereby unless
