05-877Council FYIe # �S' d � 7 Green Sheet # 3027900 RESOLUTION OF SAINT PAUL, MINNESOTA 3( Presented by 1 BE IT RESOLVED, that, upon the petition of HCA Building Company, as documented in Real Estate 2 Division File Number 10-2005, public property hereinafter described aze vacated and discontinues as 3 public properry: Drewry Lane, as platted in Irvine's 2" Addition to Saint Paul, lying southerly of south line of L.ot 7, Block 3, Irvine's 2" Addition extended easterly and lying north of a line beginning at a point along the westerly right of way line of said Drewry Lane distant 8.00 feet southerly from the northeast corner of Lot 9, said Block 3 and terminating at the easterly right of way line of said Drewry Lane distant 8.00 feet southerly from the northwest corner of I,ot 13, Block 2, Irvine's 2" Addition to St. Paul. 10 BE IT FURTHER RESOLVED, that, this vacation shall be subject to the terms and conditions of 11 Chapter 130, codified March l, 1981, of the Saint Paul legislative Code as amended, and to the 12 following conditions: 13 1. That the petitioners, their successors and assigns shall pay $1,200.00 as an administrative 14 fee far this vacation which is due and payable within 60 days of the effective date of the 15 resolution. 16 2. That the peririoners, their successors and assigns, shall be responsible for all costs and 17 expenses for the removal of street lights on any portion of vacated Drewry Lane. 18 3. That the peritioners, their successors and assigns, shall be responsible all costs and 19 expenses for the reconshuction of Drewry Lane to the sarisfaction of the Department of 20 Public Works, which shall include, but not be limited to, street pavement, curb, gutter, 21 sidewalk, and boulevard. 22 4. That the petitioners, their successors and assigns, shall make application with Ramsey 23 County Department of Records and Revenue for the combina6on of Lots 8, 9, and 10, 24 Block 3, Irvine's 2" Addition, into one tasable parcel. 25 5. That the petitioners, their successors and assigns, shall continue to provide access, 26 acceptable to the Fire Department, for the homes at 687 and 691 Drewry Lane until 27 removal of the homes or until the homes have been vacated and said properties aze 28 completely fenced in. os- g7� 2 Q That the petirioners, their successors and assigns, shall dedicate to the City of Saint Paul an easement for street purposes on, over, under and across the following described azea: The south 23.0 feet of the west 10.0 feet of Lot 13, Block 2, Irvine's 2° Addition to St. Paul. 3 4 5 6 7 9. That a permanent utility easement shall be retained on, over, under and across the vacated area on behalf of the Board of Water Commissioners of the City of Saint Paul, to reserve the right of the Board to maintain and operate any water facility in or upon said easement and to enter upon said easement, or any portion thereof, at any time and from rime to time, for the purposes of future conshuction, reconshuction, inspection, maintenance, ar repair of the same or, any part thereof. Said utility easement shall be subject to the following requirements: 9 8. That the peritioners, their successors and assigns, realize that due to the configuration of 10 the dead-end street a substanrial amount of snow may be plowed in front of their 11 driveway during City snow plowing operations, and they agree to be responsible for the 12 removal of this snow &om in front of their driveway. 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 a. No buildings, shuctures, trees or any temporary structure, material storage, fixture, or any other objects which may prohibit normal access to utility facilities for maintenance purposes will be permitted within the easement area. That the petirioners, their successors and assigns, agree to allow the City's street maintenance equipment to pull into their parking lot for maneuvering while performing snow plowing and street maintenance functions. b. Improvements in or upon the above described easement that do not prohibit the Board from exercising its reserved rights may be allowed by obtaining written permission from the Saint Paul Regional Water Services with the understanding that the restoration and costs of such improvements shall be the sole responsibility of the petitioner, its successors and assigns in the event the Board excercises its reserved easement rights. c. Should it be necessary that the petitioner's works or improvements be removed or damaged as a result of the Saint Paul Regional Water Service's operations, all removal, replacement or modification costs shall be borne solely by the petitioner. � e. No change from the existing grade within the easement area shall be permitted without written permission from Saint Paul Regional Water Services. No change in surfacing within the easement area shail be permitted without written permission from Saint Paul Regional Water Services. 36 f.
