PAUL FILE NO OFFICE OF THE CITY CLERK COUNCIL RESOLUTION- GENERAL FORM PRESENTED BY COMMISSION 231259 WHEREAS, In the matter of Comptroller's Contract L- 6833 -28- for the Rebuilding of the Sheer Fence under Robert Street Bridge, main channel Mississippi River, Industrial Construction Division, Allied Structural Steel Company, Contractors, the specified date of completion was August 23, 1966, and WHEREAS, The Contractor ordered materials in advance of receiving the award of the contract, but because the Federal Government purchased several hundred million board feet of lumber, with a high priority rating in behalf of the Vietnam War and at the same time the Federal Government tied up most available railway flatcars for the movement of their purchases, the delivery of materials for the Contractor was unavoid- ably delayed 36 calendar days, and WHEREAS, The Contractor prosecuted the work diligently to the extent of working overtime daily from June 22, 1966, to the actual completion date of October 19, 1966; now, therefore, be it RESOLVED, That the City Council does hereby authorize and approve an amendment to said Contract extending the time of completion to October 19, 1966, provided, however, that this resolution shall have no force or effect unless the sureties on the Contractor's bond consent thereto and file such consent in writing with the City Comptroller; and be it FURTHER RESOLVED, That the City of St. Paul hereby waives all claim for liquidated damages for 36 calendar days of such extended period from August 23, 1966, to and including September 27, 1966, and that no Engineering and Inspection costs on this project will be charged to the Contractor for the 36 calendar day extended period; and be it FURTHER RESOLVED, That the Contractor shall be required to pay liquidated damages of $100 per calendar day for that period of the extended time from September 28, 1966, to and including October 19, 1966, and that Engineering and Inspection costs of $531.68 for this period shall be also charged to the Contractor; and be it FURTHER RESOLVED, That the effectiveness of this resolution shall be conditioned upon the Contractor filing its written acceptance to the terms hereof with the Comptroller within 15 days after the passage of this resolution.
