Peterson COMMISSIONE 231143 FILE CIL NO. - 1 WHEREAS, Northwestern Bell Telephone Company, a duly constituted public utility company under and pursuant to the laws of the State of Minnesota, has filed several applications with the Commissioner of Public Works for the installation and maintenance of public outdoor coin telephone booths in accordance with the provisions of Chapter 51 of the St. Paul Legislative Code, as amended by Ordinance No. 12724, approved May 19, 1964; and said Commissioner of Public Works has duly investigated said applications and made his report recommending the granting of each; Inow, therefore, be it RESOLVED, by the Council of the City of St. Paul, that said Council hereby finds that the subject installations will serve public convenience and necessity and will not constitute a substantial hindrance or hazard to public traffic; and said Council hereby grants each of said applications and authorizes the Commissioner of Public Works to issue to the applicant company a City of St. Paul Permit, subject to and in compliance with the terms and conditions of said Chapter 51 of the St. Paul Legislative Code as so amended, such installa- tions to be at the following specified sites: (1) In boulevard area5' south of the curb on Thomas Avenue and 7' west of the curb on North Hamline, (2) In boulevard area 11' east of the curb on Lexington Parkway between Aurora and Fuller Avenues, south side of booth to be even with adjacent driveway, T (3) In boulevard area 31 west of the curb on Western Ave. and 5' south of the sidewalk line on Minnehaha. We respectfully refer the attention of the Council to Chapter 51 of the Saint Paul Legislative Code which pres- cribes the regulations governing installation of pay telephones upon public prop qty, and pursuant to Section 51.05, Subdivision 2, the permittee, Northwestern Bell Telephone Company, would be required to pay to the City, on a quarterly basis, "the equiva- lent of 17% of the gross revenues derived'? from the operation of each such pay telephone; and this sum is qualified by Section 51.05, Subdivision 1, which provides that the City shall reimburse the permittee the annual sum of $19.00 per telephone booth, plus a stated additional sum for excess elec- tric usage, said reimbursement being intended to pay the permittee for electric service used to light and illuminate the telephone booth. In the year 1965 the City received the sum of $5,235.61 from Northwestern Bell, and the sum of $906.99 was reimbursed for electric service, ,thereby giving the City the net sum of $4,328.62.
