RESOLVED, by the Council of the City of Saint Paul,
pursuant to the applicable Minnesota State Statute, Section
117.42, Minnesota Statutes Annotated, that an appeal having
been taken thereto and now is pending in the District Court
in and for the County of Ramsey and State of Minnesota, from
the Award of,Damages in the amount of $31,750.00, as made and
confirmed by'the prior resolution of the Council, Council File
No. 230840, approved November 16, 1966, for the condemnation
and taking under power of eminent domain, by said City, -of the
following described land, situate therein, to -wit:
Lots one (1) , two (2) , and westerly twenty (w' ly 20)
feet of Lot three (3) and the northerly nine (n'ly 9)
feet of the easterly one hundred (e'ly 100) feet of
Lot three (3) , all of Lots five (5) , six (6) , seven (7) ,
eight (8) and nine (9) in Block eleven (11) in Youngman &
Lamm's Addition, Ramsey Co., Minn., according to the plat
thereof on file and of record in the office of the Register
of Deeds in and for Ramsey County, Minnesota;
in and by that certain public improvement'proceeding instituted,
conducted and completed therefor by said City under applicable
provisions of its Home Rule Charter, in the matter of condemning
and taking said property in connection with the opening, widening
and extending Shepard Road from Davern Street to Rankin�,Street,
described in said prior resolution; that hereby said Council ap-
propriates and sets aside in'the Treasury of said City, in a fund
thereinto be known as The�Condemnation and Award Fund, a sum
equal in amount to said'Award of Damages, to -wit: the sum of
$31,750.00, and does hereby provide for the retention thereof
therein during said appeal, it being understood that John E.
Swenson and Mary F. Swenson are to execute a stipulation for a

court order of the Ramsey C unty District Court.directing
the release of $20,000.00 o�daid moneys, and, in view of the
needs and purposes of said payment, the proper City officers
are authorized and directed to enter into said stipulation for
the release,of said $20,000.00 upon said parties furnishing a
warranty deed and proper evidence of title to the City, in
form approved by the Corporation Counsel; that upon receipt
of said court order, the proper City officers are directed to
pay $20,000:.00 to John E. Swenson and Mary F. Swenson upon
the presentment of said -deed and proper evidence of title;
that the balance shall be retained in said Condemnation and
Award Fund during the pendency of said appeal, and, further,
that the present PIR Fund 6000- L6695 -14 be encumbered to the
extent of the above recited Award, minus the payment of $20,000.00,
if made, available at all times for the payment thereof upon demand
to whomsoever shall be shown to have a clear right thereto, and
hereby further pledges the full faith and credit of said City for
the payment of any increase of said Award of Damages allowed upon
said appeal,;said appropriation to be reimbursed from Municipal
State Aid Fund 64- 194 -09.
