1 W HEREAS, the City of Saint Paul maintains 918 miles of streets within its limits which includes approximately 165 miles

W HEREAS, an ongoing absence of adequate funding for transportation and the failure of a comprehensive transportatio�
package to pass during the 2005 legislative session has required the Ciry to critically evaluate current revenues that are
available; and
WHEREAS, the City is allocated MSA dollars for maintenance and construction of the MSA street system from the State
of Minnesota; and
WHEREAS, the MSA distribution formula is applied statewide despite individual need for individual cities; and
W HEREAS, the City requests additional flexibility in how it allocates its MSA dollars to assure that the street system it is
responsible for is adequately maintained and allow it to decide the balance of its maintenance and construction needs; and
W HEREAS, increased flexibility in the use of MSA dollars does not prevent the City from building or re-building MSA
roads; and
W HEREAS, Minnesota Rules Chapter 8820.1400, subpart 3, limits the amount ot MSA dollars that may be spent on
maintenance to a maximum of 35% and the City of Saint Paul is currently at the maximum.
NOW, THEREFORE, BE IT RESOLVED, that the City of Saint Paul requests the Commissioner of Transportation for a
variance from Minnesota Rules Chapter 8820 allowing the city to use up to 45% of its MSA allotment for maintenance for the
years 2006, 2007 and 2008 while transportation funding is being considered at the Legislature; and further ,it provides that if
the Commissioner of Transportation grants the variance that the City of Saint Paul hereby agrees to indemnify, save and hold
harmless the State of Minnesota and its agents and employees of and from any and all claims, demands, actions or cause of
action arising out of or by reason of this variance in any manner than in accordance with the Minnesota Rule 8820.1400 and
further agrees to defend at its sole cost and expense and action of proceeding commenced for the purpose of asserting any
claim of whatsoever character arising as a result of granting of the variance.
BE IT FIIRTHER RESOLVED, the only money allocated for Ayd Mill Road shall be for routine
maintenance.
