05-844Covncil File # � Green Sheet # 3027804 RESOLUTION t 5 CITY OF SAINT PAUL, MINNESOTA Presented By Referred To Committee: Date August 25, 2005 WHEREAS, Neighborhood Housing and Property Improvement (NHPI) has requested the City Council to hold public hearings to consider the advisability of revoking the rental registration certificate for a duplex rental property located at 729 AURORA AVE and registered to Robin R. Duke; and WHEREAS, on August 3, 2005 St. Paul Police officers were called to 729 Aurora. It ws the third time that day police had been called to that address. On the scene, police officers witnessed an individual smoke "crack" cocaine in the lower unit. Police observed that resident Patricia Dendy was under the influence of some narcotic. Dendy's two children were awake and present at the time, and were removed from the home; and WHEREAS, from April to July the city has had to provide gazbage service to 729 Aurora. Additionally, there were at least two summary abatements issued for garbage and tall grass and weeds in the last two weeks; and WHEREAS, there are current code violations contained in enclosed correction notice; and WHEREAS, on August 12, 2005, NHPI sent the proper Notice of Intent to Revoke Rental Registration (copy attached); and WHEREAS, Robin R. Duke has not appealed said notice and the time for filing an appeal has expired; now therefore BE TT RESOLVED, that based on the foregoing, the Saint Paul City Council hereby adopts the following findings and order conceining the subject property at 729 AURORA AVE . 1. That the subject property is a duplex rental property that is required to be registered with the City's Rental Registration Program 2. That the holder ofthe Rental Registration Certificate for the subject property is Robin R. Duke. 3. That the notification requirements of Chapter 51 have been fulfilled and the time for an appeal has expired without an appeal being made. Duke 123 Colorado St E St Paul MN 55107-2244 I am writing to you in your capacity as the holder of a rental registration certificate for 729 AURORA AVE St. Paul, MN. You aze hereby notified, pursuant to the authority granted to me under Chapter 51 of the St. Paui Legisiative Code, of the City's intent to revoke the registration certificate for 729 AURORA AVE . Based on the following facts I have determined that the use and occupancy of 729 AURORA AVE constitutes a nuisance: 1. On August 3, 2005 St. Paul Police officers were called to 729 Aurora. It was the third time that day police had been called to that address. On the scene, police officers witnessed an individual smoke "crack" cocaine in the lower unit. There aze current code violations contained in enciosed correction notice. I have refened this matter to the St. Paul City Council with a recommendation to revoke the rental registration certificate. The City Council will revoke unless an appeal is filed in the next thirteen (13) days from the date of this notice. An appeal may be filed pursuant to legislative Code §18.02, by appearing in person beriveen the hours of 8:00 a.m. and 4:30 p.m. on any business day at the:City Clerk's Office, Room ll 0, City Hall, 15 W. Kellogg Boulevard, St. Paul, MN or you may appeal by a,:"�`�:`, AA-ADA-EEO Employer "'°6= � c� .z'. , w mail within the same 13 day time line. ����"1 ,, ' Once the City Council has revoked the rental registration certificate, occupancy of the property is not allowed until (1) an inspection by Neighborhood Housing and Properiy Improvement (NHPn has been conducted, (2) the Director of NHPI has detemuned the property to be in compliance with the city code and no longer constitutes a nuisance, and (3) the certificate is renewed. Note: Renting a properry without a certificate is a misdemeanor. Please call me as soon as possible to arrange a meeting to discuss how to correct this situation before the City Council acts to revoke this certificate. If all issues aze addressed, I will recommend that the revocation be withdrawn from consideration by the City Council.
