PAUL COUNCIL NO OFFICE OF THE CITY CLERK FILE COL LNCIL RESOLUTION — GENERAL FORM PRESENTED BY COMMISSIONI 227094 WHEREAS, Under Preliminary Order C.F. 225067, approved August 31, 1965, and Intermediary Order C.F. 226925, approved January 25, 1966, the City of Saint Paul proposes to improve JACKSON STREET from Eighth,Street to I.S. No. 94, and WHEREAS, Jackson Street from Tenth Street to Eleventh Street within the foregoing limits is a portion of T.H. 10 =102 and, therefore, ineligible for either Municipal State Aid or County State Aid designation and expenditure of related funds, and WHEREAS, It is the plan of the Minnesota Highway Department to eliminate the said Trunk Highway routing, but under Minnesota Statutes may not do so until after July 1, 1966, unless by specific City Council request, and WHEREAS, It is necessary that .the City award a contract before July 1, 1966, in order to complete the scheduled improvements, and WHEREAS, It appears advisable to initiate the indicated request, it being anticipated that the City will, through subsequent actions, become eligible for State and County financial aid in making future physical improvements; NOW, THEREFORE, BE IT RESOLVED, That the City of Saint Paul requests the Commissioner of Highways to turn back to the jurisdiction of the City of Saint Paul the portions of Trunk Highway 10=102 on,University Avenue from Robert Street to Jackson Street, on Jackson Street from University Avenue_to Tenth Street, on--Tenth Street from Jackson Street to Broadway Street and oil Broadway Street-from Tenth Street to Sixth Street, and r BE IT FURTHER RESOLVED, That,the City waives its-right under Commissioner o£ Highways Memorandum No.,185, dated June 28, 1965, to receive a 60 -day notice in advance of Commis- sioner of Highways Order releasing these portions of Trunk Highway 10 =102 to the jurisdic- tion of the City of Saint Paul; and that the City consents to the reversion of any released portions of Trunk Highway 10=102 prior to April 1, 1966; and that the City agrees to accept the portion of Trunk Highway 10 =102 turnback on Broadway Street from Tenth Street to Sixth Street in its existing condition, it having.been recently reconstructed or presently under - contract for reconstructing, with the understanding that this portion is not eligible for State Aid designation nor will any State funds be available for reconditioning this portion prior to or subsequent to its reversion to the jurisdiction of the City, RESOLVED FURTHER, That the City Clerk is hereby authorized and directed to send two certified copies. of this resolution to the Commissioner of Highways.
