T.H. 35E/& John Ireland Blvd. rOTAT21 i14Qa- FA-5 I CONSTRUCTION AGREEMENT THIS AGRED1ENT made and entered into by and between the State of Minnesota, Department of Highways, hereinafter referred to as the "State ", and he City of St. Paul, Minnesota, acting by and through its City Council, hereinafter referred to as the "City", / WITNESSETH: f WHEREAS the State is about to award a contract for the construction of 1 a portion of Trunk Highway No. 35E (Legislative Route No. 390) between Farrington Street and Cedar Street in St. Paul as art of the National p System of Interstate - I and Defense Highways, in accordance with plans and specifications therefor designated as State Project No. 6280 -97 and in the records of the Federal Bureau E of Public Roads as Minnesota Project 135E -4 (71) 113; and WHEREAS the City requested the State to include in its plans for said i Trunk Highway No. 35E construction, a ramp (designated as Ramp SW - J.I.B.) to carry traffic from lane S-W to John Ireland Boulevard and, as said ramp is not considered necessary for trunk highway_purposes; the City indicated its EXHIBIT "A" 54913 4• willingness to pay the State the full cost of said ramp construction; and WHEREAS the State contemplated the construction of an extension of Ninth Street from Summit Avenue to John Ireland Boulevard to a width of 26 lineal feet, as part of its aforesaid trunk highway construction project; and WHEREAS the City requested the State to construct said Ninth Street extension to a width of 44 lineal feet in order that said portion of said street may be used for two way traffic, instead of only for one way traffic as was contemplated by the' State; and WHEREAS the City indicated its,willingness to pay the State the full cost of constructing said Ninth Street extension to the extra width requested by the r City in excess of the 26 foot width contemplated by the State. IT IS, THEREFORE, MUTUALLY 9GREID AS FOLLOWS: r - The State shall duly receive bids and award a contract to the lowest qualified bidder for the construction of a portion of Trunk Highway No. 35E between Farrington Street and Cedar Street, including traffic Ramp SW- J.I.B. and the Ninth Street extension, within the corporate City limits, in accordance with i approved plans and specifications therefore dated November 17, 1965 on file in the offi�e of the Commissioner of Highways at St. Paul, Minnesota, the same being des- Mated as State Project No. 6280 -97, the specifications for Highway Construction ted January 1, 1964, and the special provisions and specifications for said State Project No. 6280 -97 on file in the office of the Commissioner of Highways at St. Paul, Minnesota. Said plans and specifications and special provisions are made a part hereof by reference with the same force and effect as though fully set forth herein. " II The City shall pay to the State the following percentages of the cost of construation to be done and performed within the corporate City limits in -2- i 54913 accordance with the aforesaid plans and specifications for State Project No. 6280 -97. Said donstruotion costs shall be based on the State's construction contract unit prices multiplied by the plans estimates of construction quantities. 1. 100 percent of the cost of constructing the off ramp "SW - J.I.B." from "Lane SW" (at,Engineers Station 0+50) to the south bound Lane of John Ireland Boulevard-(at Engineers Station 5 +98.72). (This includes roadway construction items, storm sewer facilities, lighting facilities, retaining wall; concrete walk,,'curb, and guard rail.) 2. /40.91 percent of the cost of the roadway base and surfacing constrdction'items on Ninth Street from the in -place pavement on Summit Avenue r (at Engineers Station 10+69) to the east edge of the north bound lane of John r Ireland Boulevard (at Engineers Station 14 +40). 3. In addition to payment of said percentages of the coat of said construction work the City also agrees to pay to the State a sum equal to 6 percent of the amount computed as the City's share of said construction costs, it being i understood that said additional payment by the City is the City's proportionate share of all engineering costs incurred by the State it connection with the work /Performed hereunder. III It is estimated, for accounting purposes, that the said percentages of the cost of construction work to be performed by the State hereunder and the 6 percent engineering costs incurred by tie State in connection therewith will be approximately $30,890.49. It is contemplated that all of said work as provided for in said plans, epes3.fications and special provisions for said trunk highway improvement is to be done by the State by contract duly let on a knit price basis. At such time as the State awards a contract for the performance of said work the State will { i prepare a new computation of the City's share of the construction and engineering r ;i i i k 54913 costs as aforesaid which will be based on the unit prices bid by the State's contractor, and a copy of such revised cost computation will be forwarded to the City. The City agrees to pay to the Commissioner of Highways an amount equal to said revised cost amount forthwith upon receipt of a request from the State for such payment be it more or less than said sum of $30,890.49. Payment of said 1111� revised cost amount, based on the State's plan estimates of construction quantities multiplied by the contract unit prices as aforesaid,,shall be payment in full of the City's share of all said construction and engineering costs. In consideration of payment by the State of part of the cost of constructing the aforesaid Ninth Street extension the City agrees to thereafter Vol maintain said extension of Ninth Street without cost or expense to the State. It is also agreed than inasmuch as said "SW - J.I,B." traffic ramp construction was requested by the,City that the maintenance of said "SW - J.I.B." ramp, including the storm sewer and lighting facilities, the retaining wall, concrete walk, curb and guard rail, 'shall also be the responsibility of the City, and that such maintenance shall also be performed without cost or expense to the State. V Adjustment of certain City owned frame and ring casting assemblies are to be made by the State's contractor. The City shall furnish the State's contractor with new assemblies or parts thereof where replacements ale required, without cost or expense to the State or the State's contractor; excepting replacements required of units broken or damaged by the State's contractor. In such event the City shall look to the State's contractor for reimbursement of replacement costs.
