WHEREAS, in the matter of Comptroller's Contract L -6776, for the
construction of the PORTLAND- ALBERT RELIEF SEWER SYSTEM, Wolff
Construction Company, contractor, the specified date of completion
is November 11 1965, and
WHEREAS, the Contractor prosecuted the work in a diligent manner,
progress however was interrupted on numerous occasions due to
an unusual amount of rainfall throughout the month of September,
1965, with the result that it was not possible to complete the
project by said date of completion; therefore, be it
RESOLVED, That the proper city officers be and they are hereby
authorized to execute an amendment to said contract extending
the time of completion to DECEMBER 1, 1965, provided however,
that this resolution shall have no force or effect unless the
sureties on the contractor's bond consent thereto in writing
and file such consent with the City Comptroller, and be it
FURTHER RESOLVED, That the City of Saint Paul hereby waives all
claim for liquidated damages and that no engineering and inspection
costs on this project will be charged to the Contractor on account
of such extended period.
