RESOLVED, upon the pertinent appeal, under the Zoning
Code, as amended, by Vernon R. Colon, owner of the subject real
estate, situate in the City of Saint Paul, located on the south
side of Concord Street between Andrew Street and Kansas Avenue,
more particularly described as ,Lots 7 8, and 9, Martin and
Lienaa Rearrangement of Block 32 of �rown and Jackson's Addition
to West Saint Paul, Minnesota, partially zoned in "B" Residence
District and partially zoned in Commercial District, under said
Zoning Code, that the provisions of said Zoning Code hereby are
determined and varied in their application to said real estate,
as and to the extent necessary therefor and that a special
permit hereby is granted for the extension of the Commercial
District use presently permitted on a portion of said herein -
above described real estate to all of the same; subject to the
condition that said appellant- applicant, and his successors and
assigns, shall make due compliance with all applicable provisions
of municipal ordinances, State statutes and rules and regulations
of public authorities having cognizance.

Dear Sir:
This is written in response to the appeal of Vernon R. Colon to
extend Commercial zoning over the entire•site on the south side
of Concord Street between Andrew Street and Kansas Avenue,
described as Lots 7, 8, and 9, Martin.and Leinau's Rearrangement
of Block 32, Brown and Jackson's Addition to West Saint Paul.
At the December 16, 1965, Board of Zoning Meeting, the staff
reported that in 1922 for those blocks where there was either no
alley or definite rear lot line Commercial zoning was established
at a'100 foot depth. This is the case for the above described
lots, the lots being 165.9 feet deep on the west side and 133.5
feet deep on the east side while the Commercial zoning extends
only 100 feet deep. Based upon the above considerations and
since the purpose and.intent of the Zoning Code is not to deprive
an owner of the full use of his property, the Board recommends
approval of the appeal to extend Commercial zoning over the
entire site.

Honorable Mayor and Members of the City Council:
I, Vernon R. Colon of 401 Degree of Honor Building,
Saint Paul 1, Minnesota, hereby make application for extension
of commercial zoning of Lots 7 -8 -9, Martin and Leinaus rearrange-
ment of Block 32, Brown and Jackson's Addition to West Saint Paul,
which is located at the S.E. quadrant of Concord Avenue and the new
Lafayette Extension (State Highway #56).
The property is presently occupied by two houses.
The proposed use of the property is to build a new, modern,
major brand service station which requires a depth greater than
100' for efficient operation.
There will be a need for this facility as the closest service
station is four blocks to the N.W. and 1'-'z miles to the S.E. The
latter being the Farmers Union Co -op on Concord, which has very
limited hours and is closed on week -ends.
I am making this appeal under the Legislative Code, Chapter
64.03, paragraph B.
.Enclosed is a photostat of a recent survey of the property and
the Minnesota Highway Department map showing the location with re-
gard to the new highway.
