RESOLVED, upon the pertinent appeal, under the Zoning
Code, as amended, by Mailand Construction Company, owner of the
subject premises, zoned in Heavy.`Industry District, under said
Zoning Code, described as Lots 9, 107 117 12, 13, 14, 15, and 16,
in Block 17, St. Anthony Park. The Easterly 1/2 of the vacated
alley lying Westerly and adjoining said Lot 9, all of the vacated
alley lying Easterly and adjoining said Lot 16, all the vacated
alley lying Southerly and adjoining said Lots 9 through 14, and
that part of the vacated alley lying Southerly and adjoining Lots
15 and 16 except Southerly portion thereof taken for Railroad Spur
Track, according to the plat thereof on file and of record in the
office of the Register of Deeds in and for Ramsey County, Minnesota,
that the provisions of said Zoning Code, in respect to land area
and density standards, hereby are determined and varied in their
application to said real estate as and to the extent necessary to
accommodate a 78 -unit apartment building and that a permit hereby
is granted unto said appellant, and his successors in interest, in
respect of said real estate for the installation, maintenance, and
operation of a 78 -car off - street parking lot adjoining an existing
apartment building and parking lot and that the 8 foot buffer
requirement for the parking lot is hereby waived, all in accordance
with plans dated Received November 18, 1965, and that otherwise,
said appellant- permittee, and his successors in interest and assigns,
shall make due compliance with all applicable ordinances, State
statutes and rules and regulations of public authorities having
cognizance.

This is in the matter of Mailand Construction Company's 1) appeal to relax
the density standards to permit a 78 unit apartment on•a lot of insufficient
area, 2) appeal to relax the.8' buffer planting strip immediately adjoining
an off- street parking lot, and 3) application for a permit for a 78 car off-
street parking lot in conjunction with a 78 unit apartment building. The
property is located on the soutW side of Brewster Street between Raleigh and
Fifield Streets. The legal description is attached and the property is zoned
heavy industry. _

The Site is vacant and is irregularly shaped with a frontage of 456.3 feet
along Brewster Street and an area of approximately 76,358 square feet.
On December 2, 1965, the Board.of Zoning considered this matter. The staff
reported the adjacent land uses as follows: to the north the area is developed
with single and two - family uses; to the east is commercial development; to
the south is railroad right' -of -way; and to'the west is an apartment with a
parking lot accessory•thereto. The.Zoning Code requires 78,000 square feet
of lot area for a 78 unit apartment; the applicant's property consists of an
area of 96 -,358 square feet and is therefore 1,642 square feet short in area
which amounts to a deficiency of approximately 2.17o. The required eight -foot
buffer planting strip would be immediately adjacent to an existing parking lot
to the we The staff further reported that the Traffic Engineer has re-
viewed the plan of the parking lot and recommends approval; the plans meet
the design standards for off - street parking facilities.
The Board of Zoning is of the opinion that the deficiency of lot area is
slight,,amounting to only about 27o, and that the request to waive the eight -
foot buffer strip is reasonable in that the parking lot is immediately
adjoining an existing parking lot. The Board, therefore, recommends approval
of the two appeals. The Board further recommends the approval of the 78 car
parking lot on the above described property in accordance with final plans
dated received November 18, 1965.

Genlemen:
I am the owner of those portions of hots 9, 10,
113 122 132 143 15 and 162 in Block 17, St. Anthony Park and
the vacated alleys adjacent thereto all as shown colored RED
on the print hereto attached.,-marked Exhibit IIAII and made a
part hereof, subject to easement acquired by City of St. Paul
for street slopes, cuts and fills as noted on said Exhibit UAII,
which I propose to develop with three (3) apartment buildings
having a total of 78 units. This site has an area of approxi-
mately 76,400 sq. ft. which is 1600 sq. ft under the 78,000 sq.
ft. requirement, for 78 units.
I respectfully request that the density require-
ment of the zoning code be relaxed so as to permit the 78 units
to be erected as proposed and shown on my site planewhich is
now on file in the planning board office. I do not feel that
this deficiency is sufficient enough to cause a serious d�veia-
tion from the density standards. I would like to point out
that approximately 580 sq. ft. of my property has just been
deeded to the city for street purposes, a good share of the
deficiency. It is also requested that the normal 8 ft. parking
lot setback requirement along the west line of the subject
property be relaxed to zero (0) ft. as this parking lot will be
adjoinin an exit apartment building parking lot.
I make this request under Section 64.03, Para-
graph i, of the Legislative code and enclose herewith my filing
fee (by check) in the amount of $20.00.
