An Ordinance amending the Zoning Code, Chapters
60 to 64, inclusive, of the Saint Paul Legislative
Code, pertaining to Use Districts, Height Districts,

ordinance rendered necessary for the preservation
of the public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapter 60 to 64,
inclusive, of the Saint PaulrLegislative Code, pertaining to
'Use Districts, Height Districts, and Rezoning of certain properties
in the City of Saint Paul, as amended, be and the same is hereby
further amended so as to rezone the following described property
,from "B" Residence District to "Commercial ", to -wit:
South 100 ft. of Lots 8 and 9, Block 16,
Merriam' s Rearrangement of Merriam Park
(as to Blocks 7, 81 91 10 & 16), according
to the plat thereof on file and of record
in the office of the Register of Deeds in
and for Ramsey County, Minnesota;
situate onu property located on the northwest corner of
Carroll and Prior Avenues in the City of Saint Paul; provided,
however, that such rezoning and "Commercial" use of said
property shall be restricted to the life of the structure
presently on said premises.
Sec. 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Sec. 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.

Dear Sir:
The City Council referred to the Board of Zoning the petition of
Harold Dalton to amend the Zoning Code by rezoning from "B" resi-
denceto commercial property located at the northwest corner of
Carroll and Prior Avenues. The property is'described as the south
100 feet of Lots 8 and 9, Block 16, Merriamts Rearr. of Merriam
Park. f
On November 5, 1965, the Commissioner of Finance reported the
petition sufficient with the owners of 9 of a possible 13 (69.23 %)
tracts of land within the required 100 foot radius having signed
the petition.
At the December 2, 1965,-Board of Zoning meeting, the staff reported
that the property has a frontage of 100 feet on Prior Avenue and
100 feet along Carroll Avenue with an area of 10,000 square feet.
The property is presently used by.,a two - family residence and print-
ing shop known as Draper- Dalton Mail Advertising Letter Shop. The
surrounding area is zoned "B" residence and has been since 1922.
The Board of Zoning is of•the opinion that the denial of this
rezoning would result.in an undue hardship on the applicant in
that he has been doing business on this site for approximately
twenty years. The Board of Zoning, therefore, recommends approval
of the rezoning from "B " - residence to commercial district of the
above described property. I
